Hireback. (A) The hireback needs shall be determined by the Chief of Police or his designee, at‌ least one (1) week in advance of the scheduled event. The hireback will be published on a Department Notice and posted on the various bulletin boards throughout the Department, including the union bulletin board. (B) Officers desiring to work hireback, which shall be voluntary, shall sign their name legibly in the hireback logbook maintained in the supervisor’s office of the Operations Division. Forty-eight (48) hours prior to the scheduled hireback, the duty commander will review the logbook and determine by seniority those eligible for hireback. He shall notify those officers in writing or verbally of their selection. The duty commander will note in the logbook the selection and date of notification(s). (C) In the event a senior ranking officer is not available to be hired back, when needed, a sergeant may be hired back to fill that vacancy, by seniority as determined by Civil Service date of rank. (D) In the event an officer scheduled for hireback is unable to appear, he shall notify the duty commander prior to the scheduled time of hireback. The duty commander may poll the on-duty officers on the watch to determine if any of those officers desire to work hireback to fill that vacancy, and if so, the selection shall be made by seniority. In the event an officer is scheduled to work hireback and he is delayed on a late call from his regular duty tour, the hireback shall commence as scheduled. Officers who are scheduled to work hireback, but who fail to appear and fail to provide notification on two (2) occasions within a three (3) month period shall be denied hireback for a period of three (3) months from the last non-appearance occasion. (E) Any special hireback needs, such as stake-outs, parades, etc., shall be so identified on the bulletin board postings. On a detail hireback, when five (5) or more patrol officers are hired back, at least one (1) sergeant shall be hired back for supervision purposes. ▇▇▇▇▇▇▇▇ shall first be offered to the most senior sergeants on the basis of time in grade. A detail hireback is defined as a hireback assignment in which patrol officers are needed to perform duties related to a specific task as a group; i.e., election commission hireback, and First Night Springfield. (F) Records of hireback hours shall be kept current and be returned to the officers within five (5) working days. (G) Officers scheduled to work hireback who do so on a day in which they are scheduled and in fact do work a regular duty tour, shall be restricted to working hireback at half shift increments. Officers who are scheduled to work hireback who are on a regular day off or accrued vacation, compensatory, personal day or schedule adjustment day off may work the hireback in full shift increments. The intent of this Section is to provide for the safety and protection of the officer and public by restricting work hours to one and one-half work shifts. (H) Officers working hireback are allowed one (1) fifteen (15) minute coffee break during the hireback, however, if working hireback on a regular tour of duty of eight and one-half (8 1/2) hours or more, they shall be allowed a regular lunch period. (I) Officers shall have the option to receive either paid overtime or compensatory time at the rate of time and one-half (1.5) for all hours of hireback worked. (J) Meal credits shall not be applicable in hireback situations. (K) The Criminal Investigations Division will maintain their own hireback logbook in accordance with these same guidelines. (L) The parties agree that changes made in Section 7.4 during the 1986-1987 negotiations were not intended to modify the current practice for administering hireback except in regards to the provision concerning denial of hireback. All hireback shall be offered on the basis of seniority. (M) Notwithstanding the above, officers earning overtime when participating in Honor Guard activities shall receive payment only in the form of an award of compensatory time. (N) Notwithstanding the foregoing, when overtime work is to be paid from a grant, the officer will only receive overtime pay, not compensatory time.

Hireback. (Aa) The Hireback shall be defined as overtime for which an employee returns to work because of a manpower shortage. An expected hireback needs shall be defined as a manpower shortage that is reasonably anticipated prior to the date it is needed. An unexpected hireback is a manpower shortage that arises just prior to the start of a shift. (b) Hireback shall be fairly distributed on a voluntary basis by using a hireback list based on seniority. Separate lists for long and short-term hirebacks shall be maintained on the basis of particular rank. Long-term hireback is defined as a period of greater than twelve (12) hours. Short-term hireback is defined as a period of twelve (12) hours or less. New employees and newly promoted employees will be placed at the bottom of the appropriate list according to seniority. Seniority on each list shall be determined by the Chief length of Police service for each individual within that particular rank. The employee first on the appropriate list who can fulfill the duties of the rank or classification for which the manpower shortage exists, shall be offered the hireback first. If the employee first on the list is unavailable, the next employee on the list who can fulfill the duties of the rank or classification for which the manpower shortage exists shall be offered the hireback position next, and so on. After an employee is contacted, he has the option of accepting or refusing the hireback. If the hireback is accepted, the Station Officer will advise the employee as to what time to report for duty, as well as which station to report to. If the hireback is refused, the Station Officer will proceed to the next employee on the hireback list. When an employee accepts or refuses the hireback, his name goes to the bottom of the list and the next employee becomes first on the list except for forceback situations in which an employee is required to work. The employee who works a forceback, or his designeereplacement, at‌ least one (1) week in advance if the employee so chooses to have a replacement volunteer to work the forceback for him, has the option of having his name go to the bottom of the scheduled event. The hireback will be published on a Department Notice and posted list or retaining his position on the various bulletin boards throughout the Department, including the union bulletin boardlist. (Bc) Officers desiring If, after attempting to contact all eligible employees on the list for an unexpected hireback, the manpower shortage still exists, the Fire Chief (and/or his/her designee) may require the holdover employee(s) from the preceding shift to work the hireback. For an expected hireback, which except in situations that occur where it is not practicable to use the following procedure, the Department will attempt to contact all eligible employees on the list on at least two shifts prior to the date of the hireback (on the fourth and fifth calendar days prior to the date of the hireback, if the need for a hireback is known five days in advance) before requiring the first eligible employee(s) on the applicable list who are contacted on the second shift day to work the forceback. (d) An employee who is required to work a forceback may obtain a replacement to volunteer to work part or all of the forceback for him. The employee must obtain a paramedic replacement to work for him if a firefighter replacement would result in the number of paramedics on duty to fall below the minimum necessary to staff the Department’s ambulances. (e) No employee shall be voluntary, shall sign their name legibly in the offered hireback logbook maintained in the supervisor’s office of the Operations Division. Forty-for his assigned shift. (f) Employees who have worked forty eight (48) hours continuously shall not be eligible to work a hireback, forceback, holdover for hireback, or extra duty. Those employees shall retain their position on the list and have at least twelve (12) hours off- duty before being required to work a forceback, holdover for hireback, or extra duty. (g) Any employee who has entered into a scheduled time off period (vacation, holiday, ▇▇▇▇▇ ▇▇▇, duty trade) will not be required to work a forceback, holdover for hireback or extra duty and may refuse hireback without forfeiting their position on the hireback list. A scheduled time off period shall begin at the end of the employee’s shift on the last day he is scheduled to work prior to the scheduled hirebackday(s) off, and will end at the duty commander will review beginning of the logbook and determine by seniority those eligible for hireback.
