Generation compensation for Off-take constraints. 4.10.1 Generation Compensation in offtake constraint due to Transmission Infrastructure not complete/ ready (Transmission constraint): After the Scheduled Commissioning Date, subject to the submission of documentary evidences from the Competent Authority, if the plant is ready in all respects including the dedicated transmission line to be established by the SPD to connect to the grid but the necessary power evacuation/ transmission infrastructure is not ready, for reasons not attributable to the SPD, leading to offtake constraint, the generation compensation shall be restricted to the following and there shall be no other claim, directly or indirectly against SECI:
Generation compensation for Off-take constraints. 4.9.1 Generation Compensation in offtake constraints due to Grid Unavailability: During the operation of the plant, PGVCL shall endeavor to ensure 95% of grid availability ina contract year, however, there can be some periods where the Project can generate power but due to temporary transmission unavailability, the power is not evacuated, for reasons not attributable to the SPG. In such cases, subject to the submission of documentary evidences from the competent authority, the generation compensation shall be restricted to the following and there shall be no other claim, directly or indirectly against PGVCL:

Generation compensation for Off-take constraints. 4.11.1 Generation Compensation in offtake constraints due to Grid Unavailability: During the operation of the plant, there can be some periods where the Project can generate power but due to temporary transmission unavailability, the power is not evacuated, for reasons not attributable to the Solar Power Developer. In such cases, subject to the submission of documentary evidences from the competent authority, the generation compensation shall be restricted and payable by UPPCL as under: Duration of Grid unavailability Provision for Generation Compensation Grid unavailability beyond 175 hours in a Contract Year (as defined in Article 1) Generation Compensation= (tTariff X Solar Power (MW) offered but not scheduled by the Buying Entity) X 1000 X No. of hours of grid unavailability. However, in the case of third-party sale or sale in the power exchange, as price taker, the 95% of the amount realized, after deducting expenses, shall be adjusted against the Generation compensation payable, on monthly basis. Compensation (if any) calculated as per above provision, will be paid to the SPD on an annual basis.

In such cases, subject to the submission of documentary evidences from the competent authority, the generation compensation shall be restricted to the following and there shall be no other claim, directly or indirectly against SECI: Duration of Grid unavailability Provision for Generation Compensation Grid unavailability in a billing month as beyond 4 hours in that particular billing month Generation Loss = [(Average Generation per hour during the Contract Year) × (number of hours of grid unavailability during the Contract Year)] Where, Average Generation per hour during the billing month (kWh) = Total generation in the billing month (kWh) ÷ (24 x number of days in that particular billing month) hours less total hours of grid unavailability in that particular billing month. The compensation calculated corresponding to the generation loss as above, shall be at the PPA tariff, on a monthly basis.

Generation compensation for Off-take constraints. 4.10.1 Offtake constraints due to Transmission Infrastructure / Grid Unavailability: After the scheduled commissioning date, if the plant is ready but the necessary power evacuation/ transmission infrastructure is not ready, for reasons not attributable to the SPD, then SCD for such projects may be revised as the date as on 30th day subsequent to the readiness of the Delivery Point and power evacuation infrastructure. Decision on requisite extension on account of the above factor shall be taken by DVC on case-to-case basis after examining the issue. Or The SPD may seek compensation as per extant Central Electricity Regulatory Commission (CERC) Regulations. However, it is clarified that if the Project is ready for commissioning prior to the Scheduled Commissioning Date, but the offtake is constrained because of inadequate/incomplete power evacuation infrastructure, no compensation shall be permissible.
