Fundamental Documents. This Amendment shall constitute a Fundamental Document.
Fundamental Documents. The Administrative Agent shall have received this Agreement and any Notes requested in writing at least three Business Days prior to the Closing Date, each executed and delivered by a duly authorized officer of each of the Loan Parties party thereto.

The Administrative Agent shall have received this Agreement and each of the other Fundamental Documents, including, without limitation, a mortgage, pledge and security agreement, in substantially the form of Exhibit I hereto (as amended, amended and restated, supplemented or otherwise modified from time to time, the “Mortgage, Pledge and Security Agreement”), each duly executed and delivered by the Borrower and, in the case of the Collateral Documents, the applicable Subsidiaries of the Borrower.
