Finance Document. This Second Amendment constitutes a Finance Document as such term is defined in, and for purposes of, the Common Security and Account Agreement.

This First Amendment constitutes a Finance Document as such term is defined in, and for purposes of, the Amended and Restated Common Terms Agreement, dated as of May 22, 2018, by and among the Securing Parties, Société Générale as the Term Loan Facility Agent, The Bank of Nova Scotia as the Working Capital Facility Agent, each other Facility Agent on behalf of its respective Facility Lenders and Société Générale as the Intercreditor Agent.
Finance Document. The Borrower and the Lender agree that this Agreement is a "Finance Document" for the purposes of the Common Terms Deed and, without limiting the other rights of the Lender, that the Lender, in entering into this Agreement and performing its obligations under this Agreement, has the benefit of the representations and warranties and undertakings given by the Borrower and each other Obligor under the Common Terms Deed.
Finance Document. The Agent and the Company designate this letter a Finance Document.
Finance Document. For the purposes of Facility Agreement, the Company and the Agent hereby designate this letter as a Finance Document.
