Failure to Use Required Procedures and Systems. Where customer sales have not been recorded because of failure by Concessionaire to comply with Subsection 10.3 Pricing Policy, or for any other reason, Concessionaire shall pay to the County the amount that would have been due the County, plus one and one‐half percent (1.5%) for each month that sales were not recorded. The County shall have the right to make, through a qualified shopping service, a reasonable estimate of the losses.

Failure to Use Required Procedures and Systems. Where customer sales have not been recorded because of failure by Concessionaire to comply with this section, Concessionaire shall pay to the Authority the amount which would have been due the Authority, plus Interest Charges thereon. The Authority shall have the right to make, through a qualified independent accounting consultant, a reasonable estimate of the losses, where they can be reasonably and realistically estimated. Concessionaire shall be provided a copy of the consultant’s report and be entitled to challenge the estimate, if Concessionaire has a good faith belief the estimate is inaccurate.
