Entire Monetary Obligation. Notwithstanding anything else in this Agreement (except with respect to Independent Fiduciary Fees and costs in excess of $25,000), in no event shall Defendants be required to pay any amounts other than the Settlement Amount. It is understood and agreed that Defendants’ monetary obligations under this Settlement Agreement will be fully discharged by paying the amount specified in Sections 1.35 and 3.1(b) above, and that Defendants shall have no other monetary obligations, or obligations to make any other payments under this Agreement or otherwise
Entire Monetary Obligation. Notwithstanding anything else in this Agreement, except with respect to any obligations it may be required to incur with respect to implementation of the non-monetary relief described in Section III, in no event shall Defendants be required to pay any amounts other than the Settlement Amount under this Agreement or otherwise.
Entire Monetary Obligation. Notwithstanding anything else in this Agreement, in 12 no event shall Defendants be required to pay any amounts under this Agreement or otherwise, other 13 than each Party’s portion of the Settlement Amount applicable to it, as specified in Section 1.46.
Entire Monetary Obligation. Notwithstanding anything else in this Agreement, in 26 no event shall Defendants be required to pay any amounts under this Agreement or otherwise, 27 other than the Settlement Amount, or the costs of the Structural Changes described in Part III.

It is understood and agreed that Defendants’ monetary obligations under this Settlement Agreement will be fully discharged by paying the amount specified in Sections 1.38 and 4.1(a) above, and that Defendants shall have no other monetary obligations, or obligations to make any other payments under this Agreement or otherwise.
Entire Monetary Obligation. Notwithstanding anything else in this Agreement, Defendant shall in no event be required to pay more than the Total Settlement Amount. It is understood and agreed that Defendant’s monetary obligations under this Settlement Agreement will be fully discharged by paying the amounts required under this Agreement, and that Defendant shall have no other monetary obligations, or obligations to make any other payments under this Agreement or otherwise.
Entire Monetary Obligation. It is understood and agreed that Defendants’ payment obligations under this Settlement Agreement will be fully discharged by payment of the amounts due in compliance with this Agreement, and that Defendants shall have no other monetary obligations to the Settlement Class, nor any obligations to make any other payments to Settlement Class Members under this Agreement. Under no circumstances shall Defendants’ monetary obligations to the Settlement Class exceed Sixty Million Dollars ($60,000,000.00).
Entire Monetary Obligation. In no event, and notwithstanding anything else in this Settlement Agreement, shall Xxxxxxx be required to pay any amounts other than the Settlement Amount. It is understood and agreed that Xxxxxxx’ monetary obligations under this Settlement Agreement will be fully discharged by paying the amounts specified in Section 5.1 above into the Escrow Account, and that Xxxxxxx shall have no other monetary obligations, or obligations to make any other payments under this Settlement Agreement or otherwise in connection with this Settlement or the Interpleader Action.
Entire Monetary Obligation. It is understood and agreed that Compass’s payment obligations under this Settlement Agreement will be fully discharged by payment of the amounts due in compliance with this Agreement, and that Compass shall have no other monetary obligations to the Settlement Class, nor any obligations to make any other payments to Settlement Class Members under this Agreement or otherwise. Under no circumstances shall Compass’s monetary obligations under this Agreement exceed Five Million Eight Hundred Sixty Thousand Dollars ($5,860,000.00).
