Common use of Employment in Excluded Positions Clause in Contracts

Employment in Excluded Positions. (1) An employee accepting a continuous position with the Employer which is outside of the bargaining unit shall retain his/her seniority accumulated prior to the date of leaving the bargaining unit.

Employment in Excluded Positions. (1A) An employee accepting a position of a continuous position nature which is with the same Employer which is but outside of the bargaining unit unit, shall retain his/her seniority accumulated prior up to the date of leaving the bargaining unit, for a period of ninety (90) calendar days.
