Common use of Employees on Long Term Disability Clause in Contracts

Employees on Long Term Disability. 25.1 An employee who has been on LTD and absent from work for less than twenty-four (24) consecutive months will return to the same position held by the employee immediately prior to the commencement of the LTD period, if the position still exists, provided the employee has not been displaced in accordance with the provisions of Article 20 (Staffing) and is capable of performing the essential duties of the job as certified by a qualified medical practitioner. If the position no longer exists or if the employee has been displaced, the employee may exercise seniority rights in accordance with the provisions of Article 20 (Staffing).
