Common use of Eligibility for Pay Clause in Contracts

Eligibility for Pay. In order to get sick leave with pay, each employee covered by this Agreement agrees to (1) report promptly to the department or division head the reason for his absence; (2) use sick leave only for sickness of the employee except for point 3 below and bear the burden of proof of such sickness if required by the City; and (3) a permanent employee may also use sick leave with pay for absences necessitated by illness, injury or exposure to contagious disease by a member of his immediate family. Immediate family is defined as parent, spouse, sibling brother-in-law, sister- in-law, child, step-child, parent-in-law, son-in-law, daughter-in-law, natural grandparent and grandchild. The word “spouse” shall include a civil union partner, and all “in-law” categories shall include equivalent relationships effected by means of a civil union. Presence of the employee must be actually and immediately required for bona fide serious circumstances or emergencies and absence from duty shall not exceed the period of actual need.
