Common use of Effect of Non-Compliance Clause in Contracts

Effect of Non-Compliance. To the extent that the Customer is in breach of any provision of clauses 3 and 5, the Supplier reserves the right to suspend and/or terminate all Products and Services provided to the Customer until such time as the Customer remedies the non-compliance and if the Supplier incurs any expense in remedying the effects of any of the acts or omissions referred to above, the Customer shall reimburse the Supplier on demand in the amount necessary to cover such expense. In the event that the Customer fails to remedy its non-compliance after demand, the Supplier shall be entitled to terminate this Agreement and/or any relevant Order in accordance with clause 15.5.
