EDUCATIONAL ASSISTANCE PROGRAM. The District’s Educational Assistance Program will be continued during the life of this Agreement. Employees who wish to enroll in job-related and promotion oriented courses, which will improve their job knowledge and performance, will be compensated by the District for expenses as follows: A. Out-of-pocket expenses for required textbooks and course materials may be included for reimbursement within the above dollar limits. Textbooks may be retained by the employee upon completion of the course. Courses must be taken at an accredited institution or at a non-accredited institution, if approved by the Chief of Police, or by correspondence if comparable courses are not available in local schools or if the work assignment of the individual is such that it does not permit regular classroom attendance. Courses offered by Law Enforcement organizations, associations and training providers shall be reimbursed up to the limits of one (1) above. Except for unusual circumstances, employees will not be granted time off from their regular work schedule to attend courses taken under this Provision. Courses must be approved by the Chief of Police, or designee, prior to enrollment. EDUCATIONAL ASSISTANCE PROGRAM. A. The Districtparties to this Agreement recognize the value of higher educational training and the benefits which accrue to both the individual and the ▇▇▇▇▇▇▇▇ City Fire Division from such academic development. B. Accordingly, the City of ▇▇▇▇▇▇▇▇ will provide tuition reimbursement to individual members of the Division of Fire who participate in university level courses during off-duty periods. The course/degree must be pre-approved by the Fire Chief and must be job related or related to the employee’s current position or to future city development and promotion. C. Eligibility for reimbursement under this program shall be based upon the following conditions: 1. Program eligibility shall not apply to employees having less than one year of sworn service in the ▇▇▇▇▇▇▇▇ City Division of Fire. 2. Eligibility shall apply only to courses offered by a university level institution accredited by a state department of education. 3. Reimbursement eligibility shall include the cost of course tuition and required textbooks only. Enrollment fees and other service charges shall be the responsibility of the employee. Textbooks necessary for the course of instruction shall remain the property of the employee. 4. Academic courses proposed for reimbursement under this program shall be submitted to the Chief of Fire for approval prior to enrollment. 5. Only those university level courses shall be considered for educational assistance. 6. Reimbursement will not be made for any course of instruction for which the employee is already receiving tuition aid except under provisions of a student loan program. 7. Reimbursement of tuition and book costs shall be based upon student course performance in accordance with the following schedule. “A” letter grade or numerical equivalent 100% “B” letter grade or numerical equivalent 95% “C” letter grade or numerical equivalent 60% Less than “C” letter grade or equivalent 0% 8. Course participation shall be during the employee’s off-duty hours. Participation in course study shall not be considered as hours worked nor shall there be compensation paid for travel time. 9. Upon completion of an eligible course, the employee shall submit to the Chief of Fire or his designated representative a copy of the course grade report, a receipt for necessary textbooks, and a billing statement issued by the university indicating the cost of the course instruction. Language Programs will also be covered by these provisions or employees wishing to learn another language. Reimbursement shall be made after upon presentation of proper receipts and upon completion of the course with at least a grade “C” grade or its equivalent. At the employee’s option, an advance may be secured from the District against tuition costs by agreeing to payroll deduction of the amount of the advance if: 1. satisfactory evidence of completion of the course taken is not provided to the District within thirty (30) days following completion of the course; or 2. the course is not completed with at least a grade “C” or its equivalent; or 3. the course is failed; or 4. the employee voluntarily drops the course for any reason, including voluntary shift change or termination of employment with the District. If the employee’s course is not completed due to a District required shift change or reduction in force, repayment of the advance will not be required.

Voluntary shift change: any shift change in which the individual has the ability to control movement affecting him/her adversely, i.e., promotion, reverting to his/her former position, shift sign ups, etc.

EDUCATIONAL ASSISTANCE PROGRAM. The DistrictCity will reimburse (or advance if approved by the City Manager) sums to bargaining unit members for educational expenses under the following terms and conditions: 1. A bargaining unit member must have completed one (1) year of continuous service (career or part time) with the City prior to enrolling in a course. 2. The course must be taken at a Ohio State supported and accredited college or university pursuant to and part of an established program leading to either an Associates or Bachelor’s Educational Assistance Program Degree in Fire Science, EMS Science, EMS Management or Fire Technology or similar program approved by the Fire Chief. 3. Courses must involve attendance by the member in a “classroom” situation or involve facility directed research or other projects of similar nature which receive a letter grade of A, B, C, D, or Pass/Fail (or percentage equivalents). No reimbursement will be continued during the life of this Agreement. Employees who wish to given for portfolio or non-traditional course work; provided however, that members may enroll in job-related correspondence programs offered by educational institutions as defined in (2) above, so long as the courses involve a proctored testing procedure and promotion oriented coursesa letter grade of A, which will improve their job knowledge B, C, D or Pass/Fail (or percentage equivalents). 4. Reimbursement shall only include the cost of tuition and performance, will be compensated by the District for expenses as follows: A. When an employee is in the process of acquiring a sixty (60) calendar semester unit or a ninety (90) quarter unit degree (e.g., Associate of Arts, Certificate of Achievement), or when an employee is properly authorized to enroll in a correspondence course and/or a specific course of study that may not result in a degree, said employee shall be reimbursed required textbooks up to a maximum of two thousand dollars six ($2,0006) semester hours or nine (9) quarter hours per fiscal yearquarter or semester. The City shall not reimburse fees for any course for which the bargaining unit member received a scholarship, grant, or subsidy to the extent of such aid. 8. Reimbursement of tuition and textbooks shall be made after presentation based upon member course performance in accordance with the following schedule: A 100% B 85% C 75% D or Lower 0% Pass or Satisfactory 100% If the employee’s grade is reduced because of proper receipts and upon employee’s not being in attendance due to not being permitted time off, the reimbursement shall not be reduced. 9. Upon completion of an eligible course, the member shall promptly submit to the Fire Chief, or his designee, a copy of the course with at least grade report, a “C” grade receipt for necessary textbooks, and a billing statement issued by the university or its equivalentcollege setting forth the cost of tuition. 10. Any bargaining unit member receiving reimbursement of educational expense must repay such reimbursement if he leaves the employment of the City for any reason within twelve (12) months of receiving said reimbursement and only shall reimburse such expenses that have been received within the twelve (12) month period, provided however, that if the member retires in good standing for a job related medical disability, during the referenced time period, he/she shall not be required to reimburse the City any of those said funds.

EDUCATIONAL ASSISTANCE PROGRAM. Section 1 The DistrictCompany encourages employees to obtain additional education in their fields of endeavor to develop and prepare employees for advancement opportunities and to increase the potential value of employees to the Company. Thus the Company will provide reimbursement for 75% of out of pocket expenses for tuition, lab fees, and book expenses (not including registration fees, transportation, etc.) to eligible employees satisfactorily completing approved courses as defined below. (a) To be eligible for educational assistance an employee must: (a) Be a full-time employee who has six (6) months of seniority at the time of enrollment for, and completion of, the course; or (b) Be a laid off employee who has at least six (6) months seniority at the time of enrollment for, and completion of, the course. The course(s) taken must be less than six (6) months in duration. The employee must be recalled to full time status within six (6) months of completing the course. (2) Pay all expenses of the course prior to receiving reimbursement for such course. (3) Receive written approval of the specific course from the Human Resources Department in advance. (4) Submit a tuition receipt and evidence that the course has been satisfactorily completed with a grade of at least “C” or its equivalent. (5) If an employee’s shift is changed due to a Company transfer and the employee is forced to drop the course they are currently enrolled in, they will be reimbursed for the course. The employee will make every reasonable effort to transfer their class schedule. (b) To be eligible for reimbursement under the Educational Assistance Program Program, a course of study must: (1) Be offered by an accredited college, university, or technical school. Correspondence courses are not eligible for tuition reimbursement, unless the Company decides to make an exception. (2) Contribute to the performance of the employee’s present or probable future job within the Company. (3) Require class attendance on the employee’s time. The Human Resources Department, or its designee, shall determine the appropriateness of the course or courses to be taken and approve or disapprove the course for educational assistance. Should the Company deny an employee’s request for a course, the employee shall have the right to request an immediate meeting between the Union and the Company to resolve the issue. Upon satisfactory completion of the course, the employee shall present his grade report and educational expense receipts to the Human Resources Department which will request appropriate and prompt reimbursement. (a) When the Company requires employees to attend or take part in training to maintain skill levels in their current classifications and labor grade, pay for all hours spent in class will be continued during in accordance with the life of this AgreementContract. Employees who wish go to enroll in job-related and promotion oriented courses, which school Monday through Friday from a department that is on a nine (9) hour schedule will improve their job knowledge and performance, not lose the ninth hour for pay purposes. EDUCATIONAL ASSISTANCE PROGRAM. The District’s 's Educational Assistance Program will be continued during the life of this Agreement. Employees who wish to enroll in job-related and promotion oriented courses, which will improve their job knowledge knowledge, and performance, performance will be compensated by the District for expenses as follows: A. When an employee is in the process of acquiring a sixty (60) calendar semester unit or a ninety (90) quarter unit degree (e.g., Associate of Arts, Certificate of Achievement), or when an employee is properly authorized to enroll in a correspondence course and/or a specific course of study that may not result in a degree, said employee shall be reimbursed up to a maximum of two thousand seven hundred and fifty dollars ($2,000750) per fiscal year. B. When an employee exceeds sixty (60) semester units or ninety (90) quarter units and is enrolled in upper division course work, said employee shall be reimbursed up to a maximum of four one thousand dollars ($4,0001,000) per fiscal year. C. The maximum amount that an employee may be reimbursed under this program in any fiscal year is four one thousand dollars ($4,0001,000). Out-of-pocket expenses for required textbooks and course materials may be included for reimbursement within the above dollar limits. Textbooks may be retained by the employee upon completion of the course. EDUCATIONAL ASSISTANCE PROGRAM. A. The Districtparties to this Agreement recognize the value of higher educational training and the benefits which accrue to both the individual and the Hamilton City Fire Division from such academic development. B. Accordingly, the City of ▇▇▇▇▇▇▇▇ will provide tuition reimbursement to individual members of the Division of Fire who participate in university level courses during off-duty periods. The course/degree must be pre-approved by the Fire Chief and must be job related or related to the employee’s current position or to future city development and promotion. C. Eligibility for reimbursement under this program shall be based upon the following conditions: 1. Program eligibility shall not apply to employees having less than one year of sworn service in the Hamilton City Division of Fire. 2. Eligibility shall apply only to courses offered by a university level institution accredited by a state department of education. 3. Reimbursement eligibility shall include the cost of course tuition and required textbooks only. Enrollment fees and other service charges shall be the responsibility of the employee. Textbooks necessary for the course of instruction shall remain the property of the employee. 4. Academic courses proposed for reimbursement under this program shall be submitted to the Chief of Fire for approval prior to enrollment. 5. Only those university level courses shall be considered for educational assistance. 6. Reimbursement will not be made for any course of instruction for which the employee is already receiving tuition aid except under provisions of a student loan program. 7. Reimbursement of tuition and book costs shall be based upon student course performance in accordance with the following schedule. “A” letter grade or numerical equivalent 100% “B” letter grade or numerical equivalent 95% “C” letter grade or numerical equivalent 60% Less than “C” letter grade or equivalent 0% 8. Course participation shall be during the employee’s off-duty hours. Participation in course study shall not be considered as hours worked nor shall there be compensation paid for travel time. 9. Upon completion of an eligible course, the employee shall submit to the Chief of Fire or his designated representative a copy of the course grade report, a receipt for necessary textbooks, and a billing statement issued by the university indicating the cost of the course instruction. There shall be one hundred (100%) percent reimbursement for classes taken to obtain a Paramedic's license for tuition, lab fees and required textbooks with an unlimited maximum based upon courses completed with a "C" or numerical equivalent, or for non-graded courses when the grade received is "satisfactory" or "passing". 7. Employees must submit official school transcript showing final grade received. The employee shall be considered as having completed a class when he concludes the term for which the school quotes the tuition fee. 8. As funds for Educational Assistance are limited, priority shall be governed by the time and date that completed applications are received in the City Management office. EDUCATIONAL ASSISTANCE PROGRAM. Section 1 The District’s Company encourages employees to obtain additional education in their fields of endeavor to develop and prepare employees for advancement opportunities and to increase the potential value of employees to the Company. Thus the Company will provide reimbursement for 100% of out of pocket expenses, up to the maximum approved by the IRS, for tuition, lab fees, and book expenses (not including registration fees, transportation, etc.) to eligible employees satisfactorily completing approved courses as defined below. 1. To be eligible for educational assistance an employee must: a. Be a full–time employee who has six (6) months of seniority at the time of enrollment for, and completion of, the course; or b. Be a laid off employee who has at least six (6) months seniority at the time of enrollment for, and completion of, the course. The course(s) taken must be less than six (6) months in duration. The employee must be recalled to full time status before the course(s) is completed. c. Pay all expenses of the course prior to receiving reimbursement for such course; d. Receive written approval of the specific course from Human Resources in advance; e. Submit a tuition receipt and evidence that the course has been satisfactorily completed with a grade of at least “C” or its equivalent. 2. To be eligible for reimbursement under the Educational Assistance Program Program, a course of study must: a. Be offered by an accredited college, university, or technical school. Correspondence courses are not eligible for tuition reimbursement, unless the Company decides to make an exception. b. Contribute to the performance of the employee’s present or probable future job within the Company. c. Require class attendance on the employee’s time. Human Resources shall determine the appropriateness of the course or courses to be taken and approve or disapprove the course for educational assistance. Upon satisfactory completion of the course, the employee shall present his grade report and educational expense receipts to Human Resources which will request appropriate and prompt reimbursement. 1. When the Company requires employees to attend or take part in training to maintain skill levels in their current classifications and labor grade, pay for all hours spent in class will be continued during in accordance with the life of this AgreementContract. Applications will be considered if the employee is in eligible for or receiving funds for the process of acquiring a sixty same course from any other source (60) calendar semester unit or a ninety (90) quarter unit degree (e.g.GI ▇▇▇▇, Associate of Artsscholarships, Certificate of Achievementvocational rehabilitation, etc.). However, or when an employee is properly authorized to enroll in a correspondence course and/or a specific course of study that may not result in a degree, said employee shall be reimbursed up to a maximum of two thousand dollars ($2,000) per fiscal year. B. When an employee exceeds sixty (60) semester units or ninety (90) quarter units and is enrolled in upper division course work, said employee shall be reimbursed up to a maximum of four thousand dollars ($4,000) per fiscal year. C. The maximum amount that an employee may be reimbursed reimbursement under this program in any fiscal year is four thousand dollars ($4,000). Out-of-pocket expenses for required textbooks and course materials may be included for reimbursement within the above dollar limits. Textbooks may be retained by the employee upon completion of the course. Courses must be taken at an accredited institution or at a non-accredited institution, if approved by the Chief of Police, or by correspondence if comparable courses are not available in local schools or if the work assignment of the individual is such that it does not permit regular classroom attendance. Courses offered by Law Enforcement organizations, associations and training providers shall be reimbursed up limited to the limits difference between the other funds for which eligible or received for the same course and reimbursement in accordance with Section 5 of one (1) abovethis Article. 3. Except for unusual circumstances, employees Application will not be granted time off from their regular work schedule to attend courses taken under this Provision. Courses must be approved by the Chief of PoliceDepartment Head and Human Resources Director only for courses related to the employee's present job or related to a promotional position within the organization, or designee, prior to enrollmentsatisfy the general education requirement for such a degree. 4. Reimbursement shall be made after presentation only for courses completed at accredited (as determined by the U.S. Secretary of proper receipts Education) high schools, trade schools, college, and universities. 5. There shall be a seventy-five (75%) percent reimbursement for tuition, lab, and student fees, and required textbooks to a maximum of $2,000 per year for undergraduate courses and $3,000 per year for graduate courses based upon courses completed with a "C" or numerical equivalent, or for non-graded courses when the grade received is "satisfactory" or "passing". There shall be a Two Hundred Dollar ($200.00) limitation per fiscal year for non-credit courses (exception is medical training programs). 6. There shall be one hundred (100%) percent reimbursement for classes taken to obtain a Paramedic's license for tuition, lab fees and required textbooks with an unlimited maximum based upon courses completed with a "C" or numerical equivalent, or for non-graded courses when the grade received is "satisfactory" or "passing". 7. Employees must submit official school transcript showing final grade received. The employee shall be considered as having completed a class when he concludes the term for which the school quotes the tuition fee. 8. As funds for Educational Assistance are limited, priority shall be governed by the time and date that completed applications are received in the City Management office. Approval and reimbursement for Educational Assistance is contingent upon the availability of funds, the employee's successful completion of the course with at least a “C” grade or its equivalentcourse, and adherence to the policies and procedures. 9. Expenses such as parking and mileage shall not be part of the Educational Assistance Program. 10. The applicant, under this program shall attend classes on his own time and without compensation from the City.
