Dues Deductions. A. The list shall include each member’s name arranged alphabetically and the appropriate amount to be deducted. For new members, indicating an original copy shall be provided, upon request, of the monthly authorizing membership form signed by the individual employee. Signed authorization forms will be arranged alphabetically. For members who join the Association after October 1 and authorize payroll deductions for EASMC dues, EASMC will provide the member’s name and the total amount of prorated dues to be deducted over the remaining number of pay dates having dues deductions. c. The Association shall provide the Department of Fiscal Services annually, ten workdays prior to the second pay date in October, with a list of employees who have current membership in the Association, including each member's deductions’s name and applicable identification number. d. The Board and EASMC agree that any employee who requests dues deduction shall be responsible for full payment of the dues authorized for the current school year. An employee who is terminated or resigns their employment during the school year shall have deducted from their final salary payment an amount equal to their remaining dues authorization. The effective date authorization form shall include a statement to this effect and it shall be the responsibility of EASMC to make the employee aware of this provision before the form is completed. In the event the employee’s final salary payment shall be an amount not sufficient to meet the remaining dues, the responsibility for collection of such monies shall rest entirely upon EASMC. e. Deductions shall be withheld in 21 equal consecutive installments, beginning with the second pay period in October. The Board will not be required to honor any authorization for deduction authorization hereafter received shall be as follows: that is delivered later than October 1. Dues Deductions. A. The Board Employer agrees to deduct Union membership dues in accordance with this Article for all employees who have authorized such deductions in writing. A copy of the OAPSE Membership Application/Dues Deduction Authorization signed by a member shall be accepted by the Employer as a valid dues deduction authorization. Payroll deduction shall be continuous unless dues deduction authorization is withdrawn in a manner consistent with the withdrawal procedures set forth in the OAPSE Membership Application/Dues Deduction Authorization signed by the employee. OAPSE shall notify the Employer when the dues deduction authorization is properly withdrawn by the employee. The Board will notify the Local Union President when a new employee is hired. The President or their designee will be given time to meet with the new employee to explain the role and benefits of the Union and present a Membership Application/Dues Deduction Authorization card. The Treasurer of the Board shall deduct from the salaries of its Employees employees’ pay all dues deductions. The Association shall forward to the Treasurer by September 1 each year the amount to be deducted for that year if changed from the Paramus Public School Association of Custodians and Maintenance Workers, the Bergen County Education Association, the New Jersey Education Association of the National Education Association, or any one or any combination of such Associations as said Employees individually and voluntarily authorize the Board to deductprevious year. The option of 26 equal installments is only available to those employees who receive 26 pays over the school year. The purpose of this fee will be to offset the employee's per capita cost of services rendered by the Association as majority representative. 2. On or before June 1st preceding each membership year, the Association will notify the Board in writing of the amount of the regular membership dues, initiation fees and assessments charged by the Association to its own members for that membership year. The Representative fee shall be in the amount equal to eighty-five percent of the regular Association membership dues, fees and assessment as certified to the Board by the Association. 3. Except as otherwise provided in this Article, the mechanics for the deduction of representation fees and the transmission of such fees to the Association will, as nearly as possible be the same as those used for the deduction and transmission of regular membership dues to the Association. 4. Once during each membership year, covered in whole or in part by this Agreement, the Association will submit to the Board a list of those employees who have not become members of the Association for the then current membership year. The Board will deduct from the salaries of such employees the full amount of the representation fee in equal installments from the paychecks paid to each employee on the aforesaid list during the remainder of the membership year in question. The deductions will begin with the first paycheck paid: a. Ten (10) days after receipt of the aforesaid list by the Board; or b. Sixty (60) days after a newly hired employee begins his or her employment in a bargaining unit position, or c. The Association will notify the Board in writing of any changes in the list provided for in Paragraph 4 above and/or the amount of the representation fee, and such changes will be reflected in any deductions made more than ten (10) days after the Board received said notice. 6. On or about the last day of each month, beginning with the month this Agreement becomes effective, the Board will submit to the Association, a list of all employees who began their employment in a bargaining unit position during the preceding 30 day pay period. This list will include names, job titles and dates of employment for all such employees. 7. If an employee who is required to pay a representation fee terminates his or her employment with the Board before the Association has received the full amount of the representation fee to which it is entitled under this Article, the Board will deduct the unpaid portion of the fee from the last paycheck paid to said employee during the membership year in question. 8. The association shall indemnify and hold the Board harmless for against any improper and all claims, demands, suits and other forms of liability that may arise out of or erroneous payments made to the Association under this ARTICLE. D. By August 1st by reason of each year, the Association shall supply any action taken or not taken by the Board in conformance with an alphabetized list of members who have authorized payroll deductions, indicating the monthly amount of each member's deductions. Dues Deductions. A. 23-1 The Board agrees to deduct from the salaries of its Employees Denver Public Schools Association of Building and Grounds Service Personnel members employed by the District an amount to cover dues for the Paramus Public School Association of Custodians and Maintenance Workers, the Bergen County Education Association, the New Jersey Education Association of the National Education Associationand/or State, or any one or any combination of such Associations and/or national affiliated association(s) as said Employees employee individually and voluntarily authorize authorizes the Board to deduct, and to transmit the amount so authorized to the treasurer of the Association. A service charge $.10 per month per individual member will be retained by the District to help offset costs of such deduction. 23-2 Each person who desires to authorize such deduction shall file with the School District Secretary through the Office of the Association a signed and dated "Denver Public Schools Association of Building and Grounds Service Personnel Salary Deduction Authorization Form" authorizing the School District Treasurer to deduct from the member's earnings per pay period and to remit to the treasurer of the Association an amount equal to (1/24) of the dues required for membership in the organization(s). Such deductions forms shall be made include a waiver of all rights and claims against the Board and the School District and the officers and agents thereof for moneys deducted and remitted in compliance accordance with Chapter 233, N.J. C. 23-3 Deductions shall be made uniformly on each payroll period. The School District secretary shall not be required to honor, for any month's deduction, any authorizations that are delivered later than the tenth day of the month prior to the distribution of the payroll from which the deductions are to be made. 23-4 If a person who is absent on account of sickness, leave of absence, or for any other reason, has no earnings due for the month, no deductions will be made for that person for that month. The Association further agrees that neither any employee nor the Association shall have any claim against the employer for any improper deductions made or erroneous payments not made as the case may be unless a claim of error is made in writing to the employer within thirty (30) calendar days after the date such deductions were or should have been made, or were transmitted to the unit bank account, whichever is a longer period. 5.8 The District will conduct an employee orientation for all newly hired unit members. The District will provide the Association with at least ten (10) days advance notice of the date and time of the orientation. The Association shall be provided ten (10) minutes to orient newly hired unit members during the orientation. The Association will also be provided with a minimum of one Flex session per semester to meet with new unit members. 5.9 The District shall provide the Association with a list of the names, departments, work locations, home addresses, home telephone numbers, cell phone numbers, and personal email addresses on file with the District for all unit members on or before the following dates: October 1, March 1, and July 1. The District shall notify the Association within thirty (30) days of Board approval of the initial employment of any new unit members and provide the above information. Home addresses, home telephone numbers, cell phone numbers, and personal email addresses on file with the District will be omitted for those unit members who request that this information not be disclosed to the Association under this ARTICLEpursuant to Government Code 6205. D. By August 1st of each year, the Association shall supply the Board with an alphabetized list of members who have authorized payroll deductions, indicating the monthly amount of each member's deductions. The effective date for deduction authorization hereafter received shall be as follows: 1. Dues Deductions. A. D. Dues Deductions. A. The Board District will deduct Association dues from the pay of bargaining unit employees who authorize such deductions in writing pursuant to RCW 41.56.110. The District will transmit such funds deducted to the designated Treasurer of the Association. Cancellation of dues must be received in the business office directly from the Association. The District shall provide for automatic reinstatement of deductions for Association dues for employees returning from leave. The Association agrees to deduct from defend and hold the salaries District harmless in the application of its Employees this section. There shall be no discrimination against any employee by reason of his/her participation or lack thereof as a member of this Association. It is recognized that the negotiation and administration of this Agreement entail expenses which appropriately are shared by all teachers in the Norwich Public Schools. To this end, if a teacher does not join the League, such teacher shall, as a condition of continued employment by the Board, execute an authorization for the deduction of a service fee. In lieu of executing such an authorization for payroll deduction, the teacher may elect to pay the service fee directly to the League. Any teacher who fails to execute an authorization or to make arrangements for direct payment, shall have the service fee deducted automatically by the Board of Education beginning in January of the current school year. The service fee shall not exceed that portion of the dues amount which represents the cost of collective bargaining, contract administration and grievance adjustment. All amounts collected by payroll deduction shall be forwarded to the League in the same manner as are dues deductions. The provisions of this paragraph concerning service fees shall not apply to teachers who taught in the Norwich Public Schools prior to September 1, 1972, and who were not members of the League on that date. 6. The SCEA will then notify payroll to prevent dues from being deducted during the following year. The District shall rely upon the written notification from the Association described above prior to processing any dues deduction or revocation request. The Association shall not unreasonably delay providing notice to the District of any corrections shall be transmitted to such person as may from time to time be designated by change in the Paramus Public School Association of Custodians and Maintenance Workers by the 15th of each month following the monthly pay period in which deductions were madeunit member’s membership status.
