Dispute Resolution by the Appropriate Commission i) Where any Dispute or differences arises in relation to this agreement of any nature whatsoever including the construction, interpretation or implementation of the provisions of this agreement as well as claim made by any Party for any change in or determination of the Tariff or any matter related to Tariff or claims made by any Party which partly or wholly relate to any change in the Tariff or determination of any of such claims could result in change in the Tariff, and relates to any matter agreed to be referred to the Appropriate Commission, shall be submitted to adjudication by the Appropriate Commission. Appeal against the decisions of the Appropriate Commission shall be made only as per the provisions of the Xxxxxxxxxxx Xxx, 0000, as amended from time to time.

Govt., of Karnataka In the event that the parties are unable to resolve any dispute, controversy or claim relating to or arising under this Agreement, as stated above, the same shall be referred to the appropriate commission/GoK, such Dispute shall be submitted to adjudication of the State commission/State Govt.,i.e Karnataka Electricity Regulatory Commission/GoK.

Appeal against the decisions of MPERC shall be made only as per the provisions of the Xxxxxxxxxxx Xxx, 0000, as amended from time to time.
Dispute Resolution by the Appropriate Commission. (a) All Disputes shall be submitted for adjudication by the Appropriate Commission in accordance with Applicable Laws. The decision of Appropriate Commission shall be final and binding on the Parties, subject to statutory right of appeal. In the event that the Appropriate Commission refers the subject matter of any Dispute or part thereof to be adjudicated by way of arbitration, the Parties shall follow the process for arbitration as set out in Article 21.4.

Buyer shall be entitled to co-opt the Discoms as a supporting party in such proceedings before the Appropriate Commission.
