Despite anything contained in this Agreement but without prejudice to this Article, if any provision of this Agreement shall be in deviation or inconsistent with or repugnant to the provisions contained in the Electricity Act, 2003, or any rules and regulations made there under, such provision of this Agreement shall be deemed to be amended to the extent required to bring it into compliance with the aforesaid relevant provisions as amended from time to time.
According to Article 7undecies, § 11 of the Electricity Act, the financing rules of this provision must enable XXXX to have the necessary financial resources to pay the Monthly Remuneration; for this reason, these financing rules are essential to perform the Contract.
Appeal against the decisions of the Appropriate Commission shall be made only as per the provisions of the Electricity Act, 2003, as amended from time to time.
Act or Electricity Act means the Electricity Act, 2003 and includes any modifications, amendments and/or substitutions from time to time.
