Deposit and Use of Company Funds. All capital contributed to the Company shall be made to or deposited in a separate Company account or accounts in such banks or other financial institutions as may be selected by the Board of Managers. Such account or accounts shall be maintained in the name of or for the benefit of the Company. All revenues, bank loans, proceeds and other receipts shall be deposited and maintained in such account or accounts, which may or may not bear interest, and all expenses, costs and similar items payable by the Company shall be paid from such accounts. The Company’s funds, including, but not limited to, Company revenue and the proceeds of any borrowing by the Company, may be invested as the Board of Managers deems advisable. Any interest or other income generated by such deposits or investments shall be considered part of the Company’s account. Company funds from any of the various sources mentioned above may be commingled with other Company funds, but not with the separate funds of any other Person, and may be withdrawn, expended and distributed as authorized by the terms and provisions of this Agreement.

Deposit and Use of Company Funds. Except as otherwise provided in Section 9.2 and except with respect to the Initial Preferred Equity, all cash Capital Contributions shall be made to or deposited in a separate Company account or accounts in such banks or other financial institutions as may be selected by the Managing Member, provided that each such account is a Jointly Controlled Account. Such account or accounts shall be maintained in the name of or for the benefit of the Company. All Company revenues, loans, proceeds and other receipts shall be deposited and maintained in such Jointly Controlled Account(s), which may or may not bear interest, and all expenses, costs and similar items payable by the Company shall be paid from such accounts. The Owner and each Subsidiary may have separate accounts into which proceeds and revenues shall be deposited and from which all expenses and costs shall be paid, provided that, except for the Property Accounts and the Qualifying Mezzanine Borrower Accounts, all such accounts shall be Jointly Controlled Accounts. The Company’s (and each Subsidiary’s) funds, including, but not limited to, the Members’ cash Capital Contributions, Company revenue and the proceeds of any borrowing by the Company, may be invested on a short-term basis in Permitted Investments. Any interest or other income generated by such deposits or investments shall be considered part of the Company’s (or the applicable Subsidiary’s) account. Company funds from any of the various sources mentioned above may be commingled with other Company funds, but not with the separate funds of any other Person, and may be withdrawn, expended, paid and distributed only as authorized by the terms and provisions of this Agreement. The undersigned acknowledges that the Company is a start-up company with no current operations, assets or operating history, which may possibly cause a loss of Purchaser’s entire investment in the Company.

  • Account Information The account balance and transaction history information may be limited to recent account information involving your accounts. Also, the availability of funds for transfer or withdrawal may be limited due to the processing time for any ATM deposit transactions and our Funds Availability Policy.

  • Establishment of and Deposits to Escrow Account The Company shall segregate and hold all funds collected and received pursuant to a Mortgage Loan constituting Escrow Payments separate and apart from any of its own funds and general assets and shall establish and maintain one or more Escrow Accounts, in the form of time deposit or demand accounts, titled, "National City Mortgage Corp., in trust for the Purchaser of Conventional Residential Fixed Rate Mortgage Loans, Group No. 2001-1 and various Mortgagors".
