Defective Stripes or Markings. The contractor shall replace the long-life preformed patterned contrast pavement marking tape determined to be in nonconformance with the specifications. The contractor shall replace the long-life preformed patterned contrast pavement marking tape determined not to be in the locations specified. The contractor shall replace the long-life preformed patterned contrast pavement marking tape determined not to be in the dimensions specified. The contractor shall replace the long-life preformed patterned contrast pavement marking tape if the white portion of the marking does not have an average initial retroreflectivity value of 500 millicandelas per square meter per square foot per foot-candle [(mcd • ft-2) • fc-1]. The metric equivalent shall be expressed as millicandelas per square meter per lux [(mcd • m-2) • lx-1]. The test distance shall be 98.4 feet (30 m), as measured with a LTL-2000 Retroreflectometer. Three random retroreflectance measurements will be made for each 3.048-meter broken line. Replace the entire 10-foot broken line if the line has been determined to have a deficiency. Remove the defective stripes or markings as specified in subpart 610.03.08 of the Standard Specifications. THE FOLLOWING SUBPART IS ADDED:

  • Correction of Defective Work 2.10.1 Design-Builder agrees to correct any Work that is found to not be in conformance with the Contract Documents, including that part of the Work subject to Section 2.9 hereof, within a period of one (1) year from the date of Final Acceptance of the Work or any portion of the Work, or within such longer period to the extent required by the Contract Documents or applicable Legal Requirements or Government Approvals.

  • RE-WEIGHING PRODUCT Deliveries are subject to re- weighing at the point of destination by the Authorized User.   • Defective Equipment Provided that you are in compliance with all terms and conditions of this Agreement, while you receive Internet Service under this Agreement, Viasat will, at no additional charge to you, replace Equipment you lease from Viasat that Viasat, in its sole discretion, determines to be defective (“Defective Equipment”). Defective Equipment replacement under this Section 4 expressly excludes charges for home service calls and for damage to, or misuse of, the Equipment.   • Failure to Supply Workmen or Materials or to Prosecute the Work A Notice of Non-Compliant Work may be issued for failure of the Contractor to supply enough workers or enough materials or proper materials to prosecute the Work. A Notice of Non-Compliant Work in such event may be based on Article 3.3.2 (Competent Management of Time), and upon the definition of Work as set forth under Paragraph 1.1.9.58.

  • Quality of Materials and Workmanship Unless otherwise specified, all materials shall be new, and both workmanship and materials shall be of good quality. The Contractor shall, if required, furnish satisfactory evidence as to the kind and quality of materials and work. The burden of proof is on the Contractor.
