Dedication for Public Use. Upon being directed by Declarant or its successor to do so, as long as Declarant is a Class B Member, to promptly dedicate such streets, roads and drives, and such water, sewer or other utility lines or facilities, and appropriate easements as may be specified by Declarant or its successors to such municipalities, utility companies, political subdivisions, public authorities, or similar agencies or bodies as may be designated by Declarant or its successor.
Dedication for Public Use. Subject to the terms and conditions of this Agreement, the Successor Agency shall dedicate and transfer its interest in and to the Property to the City. In consideration of the Successor Agency’s conveyance of the Property, the City agrees to accept the Property subject to the following conditions: (i) the City shall hold the Property in trust to be used as a historic public theater for the benefit of the health, safety, comfort, and recreation of the citizens of the Parties (“Dedicated Purposes”); and (ii) the conveyance shall be subject to an express condition subsequent that if the City diverts the Property from the Dedicated Purposes at any time during the Dedicated Purposes Period as defined below, the Property shall revert to the Successor Agency, its successors or assigns to be held in trust for the benefit of the Successor Agency and the Taxing Entities to be sold pursuant to Section 3 of this Agreement. For purposes of this Agreement, the term “Dedicated Purposes Period” shall be the period commencing on the date of the recording of the Deed (as defined in Section 2 of this Agreement) transferring the Property to the City (“Transfer Date”) and terminating 30 years after the Transfer Date.

  • RELEASE OF GENERAL INFORMATION TO THE PUBLIC AND MEDIA NASA or Partner may, consistent with Federal law and this Agreement, release general information regarding its own participation in this Agreement as desired. Pursuant to Section 841(d) of the NASA Transition Authorization Act of 2017, Public Law 115-10 (the "NTAA"), NASA is obligated to publicly disclose copies of all agreements conducted pursuant to NASA's 51 U.S.C. §20113(e) authority in a searchable format on the NASA website within 60 days after the agreement is signed by the Parties. The Parties acknowledge that a copy of this Agreement will be disclosed, without redactions, in accordance with the NTAA.

  • POST PUBLIC AUCTION 5.1. Any E-Bidders who successfully bids for the Property shall and undertake to sign the Memorandum of Sale and pay the difference between 10% of the purchase price and the deposit paid under clause 3.5 above (“differential sum”) at the office of the Auctioneer within same day from the date of auction, failing which the deposit paid will be forfeited to the Assignee Bank and sale will be deemed cancelled/terminated and the property may be put up for subsequent auction without further notice to the said E-Bidders. The Auctioneer shall send the Memorandum of Sale for stamping and thereafter forward the same together with the deposit paid under clause 3.5 above and the differential sum paid under this clause (If any) to the Assignee Bank.

  • Public Works Installation work which is considered public works is excluded from purchase under this Contract. Historically, the New York State Bureau of Public Works has maintained that installation, maintenance and repair of equipment attached to any wall, ceiling or floor or affixed by hard wiring or plumbing is public work. In contrast, installation of a piece of equipment which is portable or a “plug-in” free-standing unit would not be considered public work. Thus, this Contract does not authorize installation where the equipment becomes a permanent part of the building structure, or is otherwise incorporated into the fabric of the building (e.g., installation on a wall, ceiling or floor in a fixed location, or affixed by hard-wiring or plumbing). See Xxxxxxxx X, §00, Prevailing Wage Rates - Public Works and Building Services Contracts.   • Termination for Public Convenience Enterprise Services, for public convenience, may terminate this Master Contract; Provided, however, that such termination for public convenience must, in Enterprise Services’ judgment, be in the best interest of the State of Washington; and Provided further, that such termination for public convenience shall only be effective upon sixty (60) calendar days prior written notice; and Provided further, that such termination for public convenience shall not relieve any Purchaser from payment for Goods/Services already ordered as of the effective date of such notice. Except as stated in this provision, in the event of such termination for public convenience, neither Enterprise Services nor any Purchaser shall have any obligation or liability to Contractor.
