COVENANT AGAINST FEES. CONSULTANT warrants and represents that no person or selling agency has been employed or retained to solicit or secure this Agreement upon an agreement or understanding for a commission, percentage, brokerage or contingent fee, excepting bona fide employees or bona fide established commercial or selling agencies maintained or employed by CONSULTANT for the purpose of securing business. For breach or violation of this warranty, COUNTY shall have the right to terminate this Agreement and recover the full amount of such commission, percentage, brokerage or contingent fee.

For breach or violation of this warranty, the have the right to annul this agreement without liability, or at its discretion to deduct from the agreement price or consideration, or otherwise recover, the amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee.
