County’s Discretion. The County retains sole and complete discretion regarding the County’s exercise of the rights granted in this Agreement, including but not limited to whether the County will accept physical delivery or display the Art, where the Art will be displayed within the Administration Building, the manner of installation and de-installation of the Art, how long the Art will be exhibited (within the duration of this Agreement), and whether the County will use in any way images of the Art. The Artist shall not install, de-install or remove the Art from the Administration Building, or modify the Art’s display, except with the permission of the County Manager and in conjunction with an authorized County representative.

County’s Discretion. 14.4.1 If Franchisee requests County’s consideration of and consent to an assignment, County may deny or approve such request at its complete discretion.
County’s Discretion. The County may enforce the terms of this Agreement at its discretion, but if the Property owner breaches any term of this Agreement and the County does not exercise its rights under this Agreement, the County’s forbearance shall not be construed to be a waiver by the County of such term, or of any subsequent breach of the same, or any other term of this Agreement, or of any of the County’s rights under this Agreement. No delay or omission by the County in the exercise of any right or remedy upon any breach by the Property Owner shall impair such right or remedy or be construed as a waiver. The County shall not be obligated to the Property Owner, or to any other person or entity, to enforce the provisions of this Agreement.
County’s Discretion. Where in this Agreement the County is given discretion, or the right to make a decision, in matters relating to the administration of this Agreement the County shall act by its Clerk or such other officer as the Clerk or Council of the County may designate for such purpose. Before exercising its discretion or making its decision, the County may seek the advice of a Solicitor, an Engineer or a planning or other consultant as may be relevant to the matter in respect of which the discretion is to be exercised or the decision to be made.
County’s Discretion. Enforcement of the terms of this easement shall be at the discretion of the COUNTY, and any forbearance by the COUNTY to exercise its rights under this easement in the event of any breach of any terms of this easement by the MUNICIPALITY shall not be deemed or construed to be a waiver by the COUNTY of such terms or any subsequent breach of the same or any other term of this easement or of any of the COUNTY’S rights under this easement. No delay or omission by the COUNTY in the exercise of any right or remedy upon any breach by the MUNICIPALITY shall impair such right or remedy or be construed as a waiver.
