County Manager. 22 If the Department Head's response does not resolve the grievance, the 23 grievance shall be submitted to the County Manager within five (5) 24 working days from the expiration of the five (5)-working-day period for 25 response at Step 1. (1) Monitor the efficiency and effectiveness of the personnel system, and the faithful execution of the merit concept called for in the Charter and this Personnel Code;
(2) Oversee the implementation of a merit personnel system and other personnel provisions mandated by the Charter and this Personnel Code;
(3) Establish overall personnel policies;
(4) Give final approval to the personnel policies and procedures developed by the Head of Administrative Services;
(5) Submit proposed provisions of the Personnel Code requiring adoption and/or amendment by the County Council, pursuant to the Charter.
(6) Bear the ultimate responsibility for the operation of the personnel system.
County Manager i. Provide leadership and coordination of all services between VCTC and COUNTY as specified in this Agreement.
ii. Ensure that the County’s liability and property insurance policy includes VCTC.
1. For Fiscal Year 2022/23, VCTC will continue with its current liability insurance broker, and VCTC may or may not maintain its membership with POOL ro PACT or otherwise may not be aligned with the same insurance broker or carrier as that of the County.
2. For Fiscal Year 2023/24, the liability and property insurance policy of VCTC will be that of County, and County will include VCTC in its policy pursuant to the policies and procedures of County, broker and carrier.

If the aggrieved party/Union is not satisfied with the disposition of the grievance at Step 2, or if no decision has been rendered within twenty (20) calendar days after filing of that grievance at Step 2, the aggrieved party/Union may file the grievance and all supporting papers with the County Manager for review. The aggrieved member or the Union shall have his or her grievance presented by a designated representative of the Union, and the Union shall have the right to have the grievance presented by the Union’s legal representative. If the County Manager conducts any hearing, the Union shall be obligated to participate even if the grievant has selected his own attorney. Step 4: Arbitration In the event a grievance has not been resolved to the satisfaction of the Union at Step 3 and/or within thirty

The parties or their representatives shall jointly request from the State Conciliation Service, promptly as they may agree or not longer than fourteen (14) calendar days from receipt of the request for arbitration, a list of names of thirteen (13) arbitrators who are West Coast arbitrators. The parties shall strike names within ten (10) days from receipt of the list or within a reasonable time not to exceed 30 days, unless otherwise agreed to in writing, and shall thereafter schedule the grievance hearing date.
