CONFORMING REVISIONS TO GOVERNING DOCUMENTS. Following the Commission’s acceptance of the ISO-NE and NYISO CTS filings, the ISOs began meeting regularly to work through the requirements for implementing and administering CTS. It was established that NYISO would host the platform used by both New York and New England market participants to submit CTS bids, and would also incorporate into its real-time clearing engine the clearing of CTS bids. The ISOs also worked out the extensive details for how information and data would be communicated between the two ISOs and to their respective market participants. The ISOs have largely completed the systems and procedures required to implement and administer CTS. As part of these efforts, the ISOs have made modifications to a number of governing documents that are included with their respective tariffs filed with the Commission under Section 205 of the FPA. The revisions to the ISO-NE governing documents filed herewith are explained in the following sections of this transmittal letter. These revisions largely memorialize the agreements between ISO- NE and NYISO on how the two parties will administer CTS. The revisions also conform sections of the ISO-NE Tariff to ensure they meet the underlying objectives of CTS and also make certain adjustments to the way in which CTS will function. Finally, the revisions re-incorporate certain concepts that were included in the initial ISO-NE CTS Filing to account for modifications to the ISO-NE Tariff that have been made since the ISO-NE CTS Filing was submitted in 2012.

Any party who fails or refuses to submit to arbitration following a demand by any other party shall bear all costs and expenses incurred by such other party in compelling arbitration of any dispute. Nothing contained herein shall be deemed to be a waiver by any party that is a bank of the protections afforded to it under 12 U.S.C. §91 or any similar applicable state law.

  • Confirmation of other terms 6.1 The parties acknowledge and confirm that except as varied by this document the terms and conditions of the Management Agreement remain in full force and effect.
