Conditions of Rights-of-Way Occupancy. A. Written Approval. A Franchisee shall first obtain the written approval of the Director of Public Works prior to commencing construction within the Rights-of-Way and public places of the City. Approval shall be in accordance with relevant state and local laws and regulations, which approval shall not be unreasonably withheld. Except in cases of a bona fide emergency preventing such notice, the Franchisee shall notify the City at least ten (10) days prior to the commencement of any construction in any Rights-of-Way. The Franchisee shall not open or disturb the surface of any Rights-of-Way or public place for any purpose without first having obtained a permit to do so in the manner provided by law. Permits for emergency work shall be obtained as soon as possible, but in no case more than one (1) working day after the emergency work is initiated. All excavation shall conform with City ordinances and regulations and shall be coordinated with other utility excavation or construction so as to minimize disruption to the public.
