City Undergrounding Regulations. Unless otherwise provided in this License, all new Licensee facilities in the Public Streets or in any public or private easement shall be located underground in accordance with the applicable City codes, ordinances and regulations, as they may be amended from time to time. Nothing contained in this Section requires Licensee to construct, operate, and maintain underground any ground-mounted appurtenances such as Subscriber taps, line extenders, system passive devices (splitters, directional couplers), amplifiers, stand-by and other power supplies, network reliability units, pedestals, or other related equipment. Licensee may utilize, when granted the owner’s permission, existing conduits whenever feasible. Underground street, sidewalk, and driveway crossings not using existing conduits shall be bored unless specific approval is granted in advance by the City.
