CEO Eligibility. Notwithstanding anything to the contrary herein, the terms herein do not modify the terms of the employment agreement between the Chief Executive Officer and the Company, dated January 22, 2013, as it may be amended from time to time (the “Employment Agreement”), except that a qualifying termination that occurs within the twenty-four (24) month period commencing on the consummation of a Change in Control (as defined in the Employment Agreement), rather than the twelve (12) month period provided for in the Employment Agreement, shall be considered a qualifying termination in connection with a Change in Control for purposes of Section 5(c) of the Employment Agreement.

  • General Eligibility 1. Except as provided in #2 below, a teacher who received an evaluation rating of ineffective or improvement necessary in the prior school year is not eligible for any salary increase and remains at their prior year salary.

  • Overtime Eligibility An Employee must work at least fifteen (15) minutes beyond her normal shift before being eligible for overtime compensation.
