Best Available Technology. 5.4.3(a) All Contractors shall utilize the best available technology for reducing the emission of pollutants for diesel-powered Non-road Vehicles in the performance of this Contract. For determinations of best available technology for each type of diesel-powered Non-road Vehicle, Contractors shall comply with the regulations of the City Department of Environmental Protection, as and when adopted, Chapter 14 of Title 15 of the Rules of the City of New York (RCNY). The Contractor shall fully document all steps in the best available technology selection process and shall furnish such documentation to the Agency or the DEP Commissioner upon request. The Contractor shall retain all documentation generated in the best available technology selection process for as long as the selected best available technology is in use.
