BASIC WORKWEEK - OVERTIME - STATUTORY HOLIDAYS. The Employer reserves the right to schedule the hours of work for the workplace, meal periods, and overtime work, subject to the following definitions and provisions. The Employer will not schedule more hours than the Employer deems necessary for the operation of the workplace. The Employer will not reduce the weekly hours of work for an employee for the sole purpose of replacing those hours with an employee at a lower hourly rate. The normal workweek will be Monday to Sunday.

(b) The Basic Straight Time Workday shall consist of eight (8) hours to be worked within the hours of 7:00 a. m. and 10:00 p.m. and shall be worked within nine (9) consecutive hours, with one (1) uninterrupted hour off for a meal period at approximately the middle of the workday. (c) Overtime Pay shall be paid at the rate of one and one half (1½) times the employee's regular rate of pay for all time worked beyond the basic limits set out in Subsections (a) and (b), except for work performed on a Sunday or statutory holiday where the Subsections governing these days apply. Compensating time off shall not be given in lieu of payment for overtime worked unless mutually agreed. A part-time employee who works less than the basic workweek and restricts their availability shall sign a form so advising the Employer. Such employee shall forfeit their right to claim any hours in excess of the number of hours to which they have restricted themselves. If an employee wishes to end their restricted status, they must advise the Employer in writing. The employee’s full seniority rights will be reinstated from the date he or she advises the Employer. An employee shall not be entitled to restrict him or herself more than once per year.‌ (d) For time worked between 6:00 p.m. and 7:00 a.m., thirty (30¢) cents per hour shall be paid in addition to the regular straight time or overtime rate applicable for the employee, provided that this shall not apply to janitorial work. (e) Part-Time Employees are employees who work less than the basic straight-time workweek. If required for work for more than eight (8) hours in any one day, forty (40) hours in any one week or between the hours of 7:00 a.m. and 10:00 p.m., the provisions Subsections (c) and (d) shall apply.

  • STATUTORY HOLIDAYS (a) The following days shall be considered holidays for which full time employees shall receive eight (8) hours' pay for each statutory holiday as listed below, at their regular hourly rate of pay. Vacation, leave of absence authorized by the Company and sick leave shall not disqualify an employee from receiving their general holidays as noted above. 29.04 If a statutory holiday occurs during an employee's vacation or scheduled day off, they shall have the opportunity to take an extra day's vacation with pay or an extra day's pay. In the event the employee chooses to take an extra day off with pay, the day off selected shall be subject to Company approval. 29.05 In the event that a security guard works in a location where a statutory holiday occurs which is not recognized in this agreement, and the client closes its business for that day, and the security guard, had that not been the case, would have normally worked on that day, said security guard shall be offered work in another location for the equivalent time that the employee would have worked if such work is available. 29.06 An employee who is required to and does work on a statutory holiday shall be paid at one and one-half (1½) times their rate of pay (plus one and one-half (1½) times the overtime rate if applicable) for all hours worked on a statutory holiday and in addition, shall be paid their regular pay for the statutory holiday if they fall in accordance with the requirements specified in 29.03 above. 29.07 Senior full-time employees will be given an opportunity not to be scheduled to work both Christmas and New Year’s Day, except in the event that there are no employees available or overtime or training costs are to be incurred by the Company to accommodate the change. Requests shall be submitted forty-five (45) days in advance and the Company shall respond within ten (10) days of the request.

  • Work on Holidays An employee who is required to work, or works with prior approval, any part of a holiday shall receive holiday compensatory time for up to eight (8) hours, on an hour for hour basis, for the actual non-overtime hours worked in addition to their regular rate of pay. An employee who works overtime on a holiday shall be compensated in accordance with all applicable pay and overtime provisions. An employee must use holiday compensatory time within one (1) year after having accrued that time.
