Agreement to Restudy and Cost Reallocation. In the event that one of the contingencies listed in Article 11.3.1 occurs, at any time before the Network Upgrades, Common Use Upgrades, Shared Network Upgrades, System Protection Facilities and/or Distribution Upgrades associated with higher queued Interconnection Requests with GIA in effect prior to this GIA are completed, Transmission Provider may determine, in its discretion, that a restudy is required. If a restudy is required, Transmission Provider will provide notice to Interconnection Customer and Interconnection Customer agrees to enter into an Interconnection Study Agreement for such restudy. Transmission Provider will reevaluate the need for any Common Use Upgrade(s) and/or Shared Network Upgrade(s), and if still required, reallocate the cost and responsibility for any Common Use Upgrade and/or Shared Network Upgrade, without a restudy when possible, or with a restudy if the Transmission Provider deems it necessary in order to ensure reliability of the Transmission System. The Parties agree to amend Appendix A to this GIA in accordance with Article 30.10 to reflect the results of any cost reallocation required under this Article 11.3.2.

Agreement to Restudy and Cost Reallocation. At any time before the Network Upgrades and/or System Protection Facilities associated with higher queued Interconnection Requests with LGIA in effect prior to this LGIA are completed or planned or proposed transmission projects are completed, Transmission Provider may determine restudy is required either: (i) in Transmission Provider’s discretion or (ii) because one of the contingencies in Article 11.4.1 occurred. If a restudy is required, Transmission Provider will provide notice to Interconnection Customer and Interconnection Customer agrees to enter into an Interconnection Study Agreement for such restudy. Any restudy shall be performed, as applicable, in accordance with Transmission Provider’s Large Generator Interconnection Procedures. Transmission Provider will reevaluate the need for any cost allocated Network Upgrade and/or System Protection Facility, and if still required, reallocate the cost responsibility for such Network Upgrade and/or System Protection Facility. The Parties agree to amend Appendix A to this LGIA in accordance with Article 30.10 to reflect the results of any restudy required under this Article 11.4.2.
