Segregated Housing. Segregated housing shall mean any type of confinement of a juvenile in an individual cell separated from the general population for any duration or reason including, but not limited to, those defined within Palm Beach County Sheriff’s Office Corrections Operating Procedure #918.00 (§IV(A)). Substantial breach: A substantial breach must be either: (i) sufficiently frequent and widespread so as to be pervasive; or (ii) a breach that deviates from a material provision in a way that denies an essential benefit of this Agreement to class members. Minimal or isolated failures, noncompliance with mere technicalities, or temporary failure to comply during a period of otherwise sustained compliance will not constitute a substantial breach of a material term.

  • Segregated facilities, as used in this provision, means any waiting rooms, work areas, rest rooms and wash rooms, restaurants and other eating areas, time clocks, locker rooms and other storage or dressing areas, parking lots, drinking fountains, recreation or entertainment areas, transportation, and housing facilities provided for employees, that are segregated by explicit directive or are in fact segregated on the basis of race, color, religion, or national origin because of habit, local custom, or otherwise.
