Prosecutor means a county attorney, a municipal prosecutor,
Prosecution or “Prosecute” means the filing, preparation, prosecution and maintenance of Patents, including any and all pre-grant proceedings before any patent authority, such as interferences.
Patent Right means: (a) an issued or granted patent, including any extension, supplemental protection certificate, registration, confirmation, reissue, reexamination, extension or renewal thereof; (b) a pending patent application, including any continuation, divisional, continuation-in-part, substitute or provisional application thereof; and (c) all counterparts or foreign equivalents of any of the foregoing issued by or filed in any country or other jurisdiction.
Third Party Infringement has the meaning set forth in Section 5.1.
Patent Prosecution means the responsibility and authority for (a) preparing, filing and prosecuting applications (of all types) for any Patent, (b) paying, filing and maintenance fees relating to any Patent, (c) managing any interference, opposition, re-issue, reexamination, revocation, nullification, or cancellation proceeding relating to the foregoing, (d) deciding to abandon Patent(s) and (e) settling any interference, opposition, revocation, nullification or cancellation proceeding.
Program Patent Rights means all Patent Rights that claim or cover patentable Program Know-How, including any Program-Specific Patent Rights.
Third Party IP Claim has the meaning given to it in clause E8.7 (Intellectual Property Rights).
Appeal Tribunal means the all-citizen Tribunal duly appointed by Council to conduct hearings under this By-law; (191-08)
Appellate Tribunal means the Goods and Services Tax Appellate Tribunal referred to in section 109;
Governmental unit means a governmental unit as defined in section 101(27) of the Bankruptcy Code.
Third Party Infringement Claim has the meaning set forth in Section 6.4.
Appeals Tribunal or “AT” means the Body responsible for hearing and determining appeals set out in section 9;
Participating municipality means a municipality that is designated by or under the Act as a participating municipality in a conservation authority.
Joint Patent Rights means all Patent Rights claiming a Joint Invention.
Lawsuit means any lawsuit, arbitration or other dispute resolution filed by either party herein pertaining to any of this Warrant, the Facility Agreement and the Registration Rights Agreement.
Allegation means any written or oral statement or other indication of possible scholarly misconduct made to an institutional official.
Accused means a person accused of a violation who has not yet entered an Institution’s judicial or conduct process.
Collaboration Patent Rights means Patent Rights claiming Collaboration Know-How.
Adjudicatory proceeding means a contested case, a proceeding that may culminate in a contested case, a petition for declaratory order, a petition for expedited resolution of a negotiability dispute, or any other proceeding which may require the board or its designee to issue a decision, order, or ruling.
Appeal means a request for a review of the Floodplain Administrator's interpretation of any provision of this ordinance.
Prosecute means preparation, filing, and prosecuting patent applications and maintaining patents, including any reexaminations, reissues, oppositions, inter partes review, and interferences.
Patent Rights means the rights and interests in and to issued patents and pending patent applications (which, for purposes of this Agreement, include certificates of invention, applications for certificates of invention and priority rights) in any country or region, including all provisional applications, substitutions, continuations, continuations-in-part, divisions, renewals, all letters patent granted thereon, and all reissues, re-examinations and extensions thereof, and all foreign counterparts of any of the foregoing.
Licensed Patent Rights means:
Municipal Planning Tribunal means the Municipal Planning Tribunal for the municipal area established in terms of section 33, the joint Municipal Planning Tribunal established in terms of section 45 or the District Municipal Planning Tribunal established in terms of section 49;
Policy Grievance is defined as a difference between the parties relating to the interpretation, application or administration of this Agreement. A policy grievance may be submitted by either party at Step 2 of the grievance procedure. A policy grievance shall be signed by a CLAC Representative and submitted to the Employer. A policy grievance submitted by the Employer shall be signed by the Employer or his representative.
Prosecuting Party has the meaning set forth in Section 6.2(c).
