Examples of prevailing party in a sentence
In any action between the Parties to enforce any provision of this Agreement, the prevailing Party shall be entitled to recover its legal fees and court costs from the non-prevailing Party in addition to whatever other relief a court may award.
In the event either Party hereto is required to employ an attorney to enforce the provisions of this Agreement or is required to commence legal proceedings to enforce the provisions hereof, the prevailing Party shall be entitled to recover from the other, reasonable attorney's fees and court costs incurred in connection with such enforcement, including collection.
Except as otherwise expressly provided in this Agreement, in the event of any litigation brought in law or equity to enforce any material provision of this Agreement, the prevailing Party shall be entitled to recover its reasonable attorneys' fees and court costs from the other Party.
In the event there is a dispute under the Agreement and it becomes reasonably necessary for any Party to employ the services of an attorney, either to enforce or terminate the Agreement, with or without arbitration, the non-prevailing Party or parties to the dispute must pay to the prevailing Party or parties reasonable attorneys’ fees and, in addition, such costs and expenses as are incurred in enforcing or in terminating the Agreement.
In any proceeding brought to enforce this Agreement or because of the breach by any Party of any covenant or condition herein contained, the prevailing Party shall be entitled to reasonable attorneys’ fees in addition to court costs and any and all other costs recoverable in said action.
