The Buyer warrants that the Place of Destination is (i) reachable by the agreed means of transport and (ii) suitable and equipped, if necessary, for unloading of the Goods.
Carrier’s absence at the Place of Destination shall not prejudice the fact that Seller had successfully performed delivery of the Goods for the purpose of the Contract.
The shipping information shall include: • all instructions regarding customary documentation which may be required at the Place of Destination; • the identity of the terminal(s) at the Place of Destination, with instructions to enable the Carrier to prepare and submit necessary information to the customs or border authorities; and • any other documents requested by the Seller.
If the means of transport is not specified in the Contract, the Seller may choose a means of transport suitable for delivery of the Goods at the Place of Destination at its own discretion; in such event the Buyer hereby unconditionally accepts the means of transport chosen by the Seller and waives any claims in this regard.
The indemnity given by the Buyer to the Seller shall be no less in scope than the indemnity required by rail transport owners to comply with the Buyer’s request.4.2.9. Damage to rail transporta) It is presumed that rail transport arrive at the Place of Destination for unloading in good condition, unless the Buyer has promptly (but not later than 3 (three) hours after the rail transport arrival informed of the defects.
