Former Residents definition

Former Residents means together, the Former SSJ Residents and the Former Non-SSJ Residents. For the avoidance of doubt, the right of a Former Resident to any Distributions under the Plan shall include the heirs and successors to such Former Resident to the extent applicable.
Former Residents means a Resident (a) whose occupancy at the Facility has terminated as of the Effective Date; (b) who has provided a termination notice prior to the Effective Date; (c) who is not living at the Facility as of the Effective Date; (d) whose Residence Agreement has otherwise terminated prior to the Effective Date; (e) for which a Residence Agreement refund obligation is otherwise triggered prior to the Effective Date; and/or (f) whose Residence Agreement is the subject of a motion to reject Filed on or before the Confirmation Date.
Former Residents means a Person that was a counter-party to a Residency Agreement that no longer resides at the Clare Oaks Campus, including, without limitation, those Persons listed on the attached Schedule III(B)(5). For the avoidance of doubt, the right of a Former Resident to any Distributions under the Plan shall include the heirs and successors to such Former Resident to the extent applicable.
