ETC Servicer Agreement definition

ETC Servicer Agreement means the agreement between VDOT and the ETC Servicer for the provision of the ETC Services to the Participant.

  • In the event that pursuant to an ETC Servicer Agreement, the ETC Servicer is obligated to pay VDOT lost revenues or any other sum resulting from the default of the ETC Servicer or the non-performance of the ETC Servicer’s duties and obligations under the ETC Servicer Agreement, VDOT will promptly remit to the Participant its pro rata portion of such sums.

  • VDOT will use commercially reasonable efforts to cause the ETC Servicer to perform its duties and obligations in accordance with the ETC Servicer Agreement and the VDOT Standard Operating Procedures.
