Error definition

Error means any failure of the Software to operate in conformance with the Documentation in any material respect.
Error means a software defect in the Application Software, which consists of a nonconformity between the unmodified software and its applicable functional specifications, which for the Application Software are set forth in the Software Documentation.
Error means a material and continuing failure of the Software and Services to function in conformity with the Specifications.

  • If such Error or breach is not corrected or if an acceptable plan for correcting such Error or breach is not established within such thirty (30) day period, Whole Tomato shall replace the defective Licensed Software or, if not practicable, accept the return of the defective Licensed Software and refund to Customer the amount paid for the defective Licensed Software, less depreciation based on a 3-year straight line schedule.

  • Whole Tomato’s obligations under this Section 6(b) shall be waived in the event such Error or breach is due to (I) any defect in or misconfiguration of the computer hardware upon which the Licensed Software is installed, (II) improper handling or use of the software media by Customer, or (III) an unauthorized alteration, revision or configuration of the Licensed Software or to Customer’s computer system by Customer or its employees.

  • Customer acknowledges that this Section 6(b) sets forth Customer's sole and exclusive remedy, and Whole Tomato’s and its authorized representatives’ sole and exclusive liability, for any breach of warranty, Error or failure of the Licensed Software to function properly.

  • For purposes of this calculation, the SAAS Product will be deemed to be unavailable (referred to herein as “Unavailable”) only (i) if the SAAS Product does not respond to HTTP requests issued by Memcyco’s monitoring software, or (ii) for the duration of a Severity- 1 Error as defined in the Maintenance and Support Guide attached as a Schedule to the Agreement.

  • If an Error has been corrected or is not present in a more current version of the Product, Forcepoint will provide the more current version via Technical Support but will not have any obligation to correct such Error in prior versions.
