Cosmetic Flaw definition

Cosmetic Flaw means a material flaw in the appearance of an item (as opposed to a structural or other construction defect) which is readily visible, exceeds normal tolerances, and is substantial enough to affect the overall appearance of and materially affect the market value of the item. An obscured or minor flaw is considered to be of no consequence and to be within building industry standards and is not considered a Cosmetic Flaw. Following substantial completion of the Property, a walk-through of the Property (“Walk- through”) by the Purchaser or a representative designated by the Purchaser in writing (“Purchaser’s Representative”) will be scheduled by Seller. Any Cosmetic Flaws must be recorded during the Walk-through on the report (the “Defect Report”) to be signed by Purchaser or Purchaser’s Representative immediately following the Walk-through. Seller will promptly correct any Cosmetic Flaws that are recorded on the Defect Report. Seller will not have any obligation to correct any claimed Cosmetic Flaw not noted on the Defect Report. Without limitation, Purchaser (or Purchaser’s Representative) must carefully inspect the following items during the Walk-through as damage to the items can occur easily during move-in and, therefore, will not be warranted after Purchaser takes possession of the Property: Bathroom fixtures and finishes, towel bars, rings, toilet paper dispensers, bathtub and sink finishes, cabinets, ceramic floor tile, counter top tile, cultured marble, plastic laminate, solid surface, marble or granite surface counter tops, door and cabinet handles, vinyl, stone, tile, carpet or laminate floor coverings, tub and shower units, lighting fixtures, luminous lighting panels, mirrors and medicine cabinets, plumbing fixtures, drywall, handrails, window screens, frames and glass, doors and door trim, and appliance finishes.

  • Cosmetic means surgery, procedures or treatment and other services performed primarily to enhance or improve appearance, including but not limited to, and except as otherwise required by state or federal law, those surgeries, procedures, treatments and other services performed in the absence of a functional impairment of a body part or organ as documented in the medical record, even if such services will improve emotional, psychological or mental condition or function.

  • Cosmetic Surgery means any Surgery, service, Drug or supply designed to improve the appearance of an individual by alteration of a physical characteristic which is within the broad range of normal but which may be considered unpleasing or unsightly, except when necessitated by an Injury.

  • Cosmetology means any one and/or combination of practices generally and usually performed by and known as the occupation of beauty culturalist, cosmeticians, cosmetologists or hairdressers or any person holding him or herself out as practicing cosmetology in or upon a place or premises. Cosmetology shall include, but otherwise not be limited to, the following: embellishing, arranging, dressing, curling, waving, cleansing, beautifying, cutting, singeing, bleaching, coloring, or similar work upon the hair of any person by any means and with hands or mechanical or electrical apparatuses, devices or appliances or by use of cosmetic preparations, antiseptics, tonics, lotions, creams or otherwise, massaging, cleansing, stimulating, manipulating, exercising, beautifying or similar work, the scalp, face, neck, arms, hands, bust or upper part of the body, or manicuring, pedicuring or sculpting the nails of any person.

  • Biological safety cabinet means a containment unit suitable for the preparation of low to moderate risk agents where there is a need for protection of the product, personnel, and environment, according to National Sanitation Foundation (NSF) Standard 49.

  • Cosmetologist means an individual licensed under this chapter to practice cosmetology.

  • Food means a raw, cooked, or processed edible substance, ice, beverage, or ingredient used or intended for use or for sale in whole or in part for human consumption, or chewing gum.

  • Spatial Planning and Land Use Management Act means the Spatial Planning and Land Use Management Act, 2013 (Act 16 of 2013);

  • Crawling bug insecticide means any insecticide product that is designed for use against ants, cockroaches, or other household crawling arthropods, including, but not limited to, mites, silverfish or spiders. “Crawling Bug Insecticide” does not include products designed to be used exclusively on humans or animals, or any house dust mite product. For the purposes of this definition only:

  • Flea and tick insecticide means any insecticide product that is designed for use against fleas, ticks, their larvae, or their eggs. “Flea and Tick Insecticide” does not include products that are designed to be used exclusively on humans or animals and their bedding.

  • Occupational Health and Safety Act means the Occupational Health and Safety Act, 1993 (Act No 85 of 1993);

  • Medical marijuana waste or "waste" means unused,

  • Pesticide means any substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest, or intended for use as a plant regulator, defoliant, or desiccant, other than any article that:

  • Flying bug insecticide means any insecticide product that is designed for use against flying insects or other flying arthropods, including but not limited to flies, mosquitoes, moths, or gnats. Flying bug insecticide does not include wasp and hornet insecticide, products that are designed to be used exclusively on humans or animals, or any moth-proofing product. For the purposes of this definition only, moth-proofing product means a product whose label, packaging, or accompanying literature indicates that the product is designed to protect fabrics from damage by moths, but does not indicate that the product is suitable for use against flying insects or other flying arthropods.

  • Fungicide means any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any fungi.

  • Prescription drug means any drug required by federal law or regulation to be dispensed only

  • Restricted use pesticide means any pesticide or device which, when used as directed or in accordance with a widespread and commonly recognized practice, the director determines, subsequent to a hearing, requires additional restrictions for that use to prevent unreasonable adverse effects on the environment including people, lands, beneficial insects, animals, crops, and wildlife, other than pests.

  • Pretreatment standards means all applicable Federal rules and regulations implementing Section 307 of the Act, as well as any nonconflicting State or local standards. In cases of conflicting standards or regulations, the more stringent thereof shall be applied.

  • Soft drinks means nonalcoholic beverages that contain natural or artificial sweeteners. "Soft drinks" does not include beverages that contain milk or milk products, soy, rice, or similar milk substitutes, or that contains greater than fifty per cent vegetable or fruit juice by volume.

  • Prescription drugs means drugs, medicine and controlled substances which by law can only be prescribed for human use by persons authorized by law.

  • health and safety specification means a site, activity or project specific document prepared by the client pertaining to all health and safety requirements related to construction work;

  • Caseworker means a PCSA, PCPA or PNA staff person who is responsible for provision of protective services or supportive services to the child and his parent, guardian, custodian or substitute caregiver.

  • Therapeutic diet means meals served that are soft, low-fat, low-sodium or controlled calorie.

  • HITECH Act means the Health Information Technology for Economic and Clinical Health Act, TitleXIII, Subtitle D, Part 1 & 2 of the American Recovery and Reinvestment Act of 2009.

  • Licensed clinical social worker means an individual who meets the licensed clinical social worker requirements established in KRS 335.100.
