Breach of Privacy or Security definition

Breach of Privacy or Security means any access, use, receipt or disclosure of Patient Data (including electronic PHI) that is not in compliance with Law.

Examples of Breach of Privacy or Security in a sentence

  • Each Party shall notify the other of any suspected or actual Breach of Privacy or Security.

  • Without limiting Section 9.3 (Reports), if applicable to HIO, HIO and Participant shall report to the other any use or disclosure of Patient Data not provided for by these Terms and Conditions of which HIO or Participant becomes aware, any security incident (other than an Unsuccessful Security Incident) concerning electronic Patient Data and any Serious Breach of Privacy or Security.

  • Without limiting any Business Associate Agreement entered into pursuant to Section 10 (Business Associate Agreement), HIO and Participant shall report to the other any use or disclosure of Patient Data not provided for by these Terms and Conditions of which HIO or Participant becomes aware, any security incident (other than an Unsuccessful Security Incident) concerning electronic Patient Data and any Breach of Privacy or Security.

  • The Coalition will notify Participant within 48 hours of identifying an occurrence, activity or practice that it believes constitutes a Breach of Privacy or Security relating to Protected Health Information or Data for which Participant is the Data Provider, and subsequently follow the process outlined in the HIE Policies related to Breach Notification.

  • Both parties agree to maintain frequent and regular communication during the discovery, notification, and investigation period of a potential or confirmed Breach of Privacy or Security.

  • Business Associate shall report to Covered Entity, without unreasonable delay, and in accordance with the deadlines provided below, any use or disclosure of PHI not permitted by this BAA of which Business Associate becomes aware, including any use or disclosure involving PHI and any Breach of Privacy or Security as defined herein.

  • Participant will notify the Coalition within 48 hours of identifying an occurrence, activity or practice that it believes constitutes a Breach of Privacy or Security, and thereafter promptly take reasonable steps to cure the material breach or end the violation.

  • HIO and Participant shall report to the other any use or disclosure of Patient Data not provided for by these Terms and Conditions of which HIO or Participant becomes aware, any security incident concerning electronic Patient Data and any Breach of Privacy or Security.

  • Business Associate shall cooperate with Covered Entity and shall provide that assistance as Covered Entity may reasonably request so that Covered Entity may comply with any obligations it may have to investigate, remediate, mitigate, report, and or otherwise notify third parties of that Breach of Privacy or Security.

  • In the event of a Breach of Privacy or Security, Business Associate shall without unreasonable delay carry out an investigation and shall provide reasonably frequent updates to Covered Entity as to the results of the investigation, including, as soon as reasonably possible, the identification of each Patient whose PHI has been, or is reasonably believed to have been, accessed, acquired, or disclosed during any Breach of Privacy or Security.


More Definitions of Breach of Privacy or Security

Breach of Privacy or Security means (i) a Breach, as that term is defined in 45 CFR 164.402, with respect to Protected Health Information accessed through or made available on the HIE, or (ii) a use or disclosure of Data that is inconsistent with the terms of this Agreement and that either (1) pursuant to applicable laws or regulations, must be reported to affected individuals and/or government officials, or (2) is likely to affect the legal liability of the Coalition or any Participant. Other capitalized terms used in the Agreement but not defined in the Agreement shall have the definitions assigned to such terms under HIPAA or the HIPAA Regulations.
Breach of Privacy or Security is a use or disclosure of Shared Information other than in compliance with the Participation Agreement that either, (a) pursuant to applicable laws or regulations, must be reported to affected individuals and/or government officials, including without limitation federal or state data breach notification rules, or (b) that adversely affects either (i) the viability of NCHIIN or any Program; (ii) the trust among NCHIIN and Program Participants; or (iii) the legal liability of NCHIIN or any Program Participant.

Related to Breach of Privacy or Security

  • Breach of Security means the occurrence of unauthorised access to or use of the Premises, the Services, the Contractor system or any ICT or data (including the Authority’s Data) used by the Authority or the Contractor in connection with this Contract.

  • Breach of system security means unauthorized acquisition of computerized data that compromises the security, confidentiality, or integrity of sensitive personal information maintained by a person, including data that is encrypted if the person accessing the data has the key required to decrypt the data. Good faith acquisition of sensitive personal information by an employee or agent of the person for the purposes of the person is not a breach of system security unless the person uses or discloses the sensitive personal information in an unauthorized manner. Business and Commerce Code 521.053(a)

  • Security or Securities means Money Market Securities, common or preferred stocks, options, bonds, debentures, corporate debt securities, notes, mortgages or other obligations, and any certificates, receipts, warrants or other instruments representing rights to receive, purchase or subscribe for the same, or evidencing or representing any other rights or interest therein, or any property or assets.

  • Breach of trust means a breach of any duty imposed on a trustee by this Act or by the terms of the trust;

Good faith acquisition of personal information by an officer or employee or agent of the district for the purposes of the district is not a breach of the security of the system, provided that the private information is not used or subject to unauthorized disclosure.

  • Forcible felony means any crime defined in Iowa Code section 702.11. This includes felonious child endangerment, assault, murder, sexual abuse, kidnapping, robbery, arson in the first degree, or burglary in the first degree. Forcible felonies are not willful injury in violation of Iowa Code section 708.4, subsection 2; sexual abuse in the third degree committed between spouses; sexual abuse in violation of Iowa Code section 709.4, subsection 2, paragraph “c,” subparagraph (4); or sexual exploitation by a counselor or therapist in violation of Iowa Code section 709.15.

  • Breach of Contract means the failure of a Party to perform any of its obligations in accordance with this Contract, in whole or in part or in a timely or satisfactory manner. The institution of proceedings under any bankruptcy, insolvency, reorganization or similar law, by or against Contractor, or the appointment of a receiver or similar officer for Contractor or any of its property, which is not vacated or fully stayed within 30 days after the institution of such proceeding, shall also constitute a breach. If Contractor is debarred or suspended under §24-109-105, C.R.S. at any time during the term of this Contract, then such debarment or suspension shall constitute a breach.

  • threat of serious injury means serious injury that is clearly imminent;

  • Predecessor Security of any particular Security means every previous Security evidencing all or a portion of the same debt as that evidenced by such particular Security; and, for the purposes of this definition, any Security authenticated and delivered under Section 2.07 in lieu of a lost, destroyed or stolen Security shall be deemed to evidence the same debt as the lost, destroyed or stolen Security.

  • Quasi-Security means an arrangement or transaction described in paragraph (b) below.

  • Serious injury or illness means an Injury or Illness incurred in the line of duty that may render the member of the Armed Forces medically unfit to perform his or her military duties.

  • Similar Security means a reference bond or reference bonds issued by the same issuer as the Reference Security having actual or interpolated maturity comparable with the remaining term of the Notes that would be utilised, at the time of selection and in accordance with customary financial practice, in pricing new issues of corporate debt securities of comparable maturity to the remaining term of the Notes.
