Within East Public Street ROW. Any of Developers, their Phase 2 Successors, Sunbury or the owner or developer of the Northstar Property may elect (but shall not be required) to construct the East Public Street. In the event that Developers, any Phase 2 Successor or the owner or developer of the Northstar Property desires to undertake such construction, it shall so notify Sunbury in writing and then submit all necessary plans, specifications, and materials as required by Sunbury as a prerequisite to the issuance of relevant permits to conduct such construction. The Party which elects to construct the East Public Street Improvements shall complete the construction at the sole cost and expense, subject to the reimbursement provisions of Section 7.

Within East Public Street ROW. It is anticipated that the owner or developer of the Northstar Property will construct a public street within the East Public Street ROW (such street to be referred to herein as the “East Public Street Improvements”).
