Common use of Transfer Outside the Bargaining Unit Clause in Contracts

Transfer Outside the Bargaining Unit. (a) An employee, who is transferred to a position outside of the bargaining unit for a period of not more than twelve (12) months shall, subject to (c) below, retain, but not accumulate, her seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, she/he shall be credited with seniority held at the time of transfer and resume accumulation from date of her/his return to the bargaining unit.

(a) An employee, employee who is transferred to a position or successfully competes for a temporary position outside of the bargaining unit for a period of more than three (3) months, but not more than twelve one (121) months shall, subject to (c) below, year will retain, but not accumulate, her or his seniority held at the time of transfer.
