Transfer Outside the Bargaining Unit. (a) An employee, who is transferred to a position outside of the bargaining unit for a period of not more than thirteen (13) months shall, subject to (c) below, retain, but not accumulate her seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, she/he shall be credited with seniority held at the time of transfer and resume accumulation from date of her/his return to the bargaining unit. If an employee is transferred to a position outside of the bargaining unit for the purpose of back filling a pregnancy/parental leave only, the length of such term may be up to a period of twenty (20) months. An employee must remain in the bargaining unit for a period of at least three (3) months, unless agreed otherwise by the parties, before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer. (b) In the event that an employee is transferred to a position outside of the bargaining unit for a period in excess of thirteen (13) months, she will lose all seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, the employee's seniority will accrue from the date of her/his return to the bargaining unit. (c) It is understood and agreed that the periods of time referred to above may be extended by written agreement of the parties which would include a defined period of time. (d) The Employer will notify the Bargaining Unit President in writing of any bargaining unit member who accepts a temporary transfer out of the bargaining unit. Such notification will include the defined period of time.

Transfer Outside the Bargaining Unit. (a) An employee, employee who is transferred temporarily to a position outside of the bargaining unit for a period of not more than thirteen three (133) months shallmonths, subject or is seconded to (c) belowteach for an academic year shall not suffer any loss of seniority, retainservice or benefits. Where an employee substitutes under this paragraph as a result of a pregnancy and/or parental leave of another person, but not accumulate her seniority held at the time duration of transfer. An employee must remain in the bargaining unit for a period of at least three five (35) months, unless agreed otherwise by the parties, months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer. (b) In Subject to (a), in the event that an employee is transferred temporarily to a position outside of the bargaining unit for a period in excess of thirteen one (131) monthsyear, she or he will lose all seniority held at seniority. Additionally, in the time event that an employee accepts a permanent position outside of transferthe bargaining unit, she or he will lose all seniority. In the event the employee is returned to a position in the bargaining unit, the employee's seniority will accrue from the date of her/her or his return to the bargaining unit. (c) An employee who accepts a transfer under (a) above will not be required to pay union dues for any complete calendar month during which no bargaining unit work is performed. (d) It is understood and agreed that an employee may decline such offer to transfer and that the periods period of time referred to above may be extended by written agreement of the parties which would include a defined period of timeparties. (de) The Employer agrees that it will notify not make work assignments that violate the Bargaining Unit President in writing purpose and intent of this provision. The Employer will advise the Union of the names of any bargaining unit member who accepts a temporary transfer out employees performing the duties of positions outside of the bargaining unit, the date the assignment commenced, the area of assignment and the duration of such assignments. (a) All benefits and other credits obtained under the agreement shall be retained and transferred with the nurse if she changes her status from full-time to part-time and vice versa. (b) A part-time nurse who changes her status to full-time will be given seniority credit on the basis of fifteen hundred (1500) paid hours of part-time being equivalent to one (1) year of full-time service and vice versa.
