Common use of Transfer Outside the Bargaining Unit Clause in Contracts

Transfer Outside the Bargaining Unit. 16.09 No employee shall be transferred to a position outside the bargaining unit without that employee's consent. If an employee who has been transferred outside of the bargaining unit, other than on a provisional basis, subsequently returns to the bargaining unit, that employee shall not displace another regular employee, nor shall any time spent outside the bargaining unit count toward seniority for promotion purposes.
