Common use of Transfer Outside the Bargaining Unit Clause in Contracts

Transfer Outside the Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his/her consent. If an employee is transferred to a position outside the Bargaining Unit he/she shall retain for a period of twelve (12) months his/her seniority accumulated up to the date of leaving the unit. An employee permanently transferred outside the unit shall lose all seniority in the bargaining unit.

If an employee is transferred to a position outside the Bargaining Unit bargaining unit, with his/her consent, he/she shall retain for a period of twelve (12) months his/her seniority accumulated up to the date of leaving transfer for 12 consecutive months, or up to 24 months subject to agreement between the unit. An employee permanently transferred outside employer and the unit shall lose all seniority in the bargaining unitunion.
