To Manage and Develop Real Property. This Company may manage or develop any real property owned or acquired by the Company. Operating Agreement of Common Dwelling Fund, LLC In order to accomplish these purposes, the Company may: own, acquire, manage, develop, operate, buy, sell, exchange, finance, refinance, and otherwise deal with real, personal, tangible, and intangible property, and any type of business, as the Manager determines from time to time to be in the best interests of the Company; and conduct any lawful business and investment activity permitted under the laws of Delaware and in any other jurisdiction in which the Company may have a business or investment interest in order to accomplish these objectives. The Company may engage in any other activities that are related or incidental to these purposes, as the Manager may determine with sole and absolute discretion.

The Company and the Subsidiaries are presently in compliance in all material respects with all applicable laws or statutes and all applicable judgments, orders, rules and regulations of any court or arbitrator or governmental or regulatory authority, internal policies and contractual obligations relating to the privacy and security of IT Systems and Personal Data and to the protection of such IT Systems and Personal Data from unauthorized use, access, misappropriation or modification, except for any such noncompliance that would not have a Material Adverse Effect.
