Timely submission of a CAP. Failure to timely submit a CAP within ten (10) business days after notification of a deficiency by the Department’s Contract Manager will result in a two percent (2%) reduction of payment per business day the CAP is not received. The reduction of payment will begin the first business day following the Department’s notification to the Contractor that the identified deficiency was not cured or satisfactorily addressed in accordance with the Department-approved CAP, referenced in Section III.H.
