Termination of the Right to Use. Upon termination of this Addendum for any reason, any right to use the System and access to the Data Access Services shall terminate and the Fund shall immediately cease use of the System and the Data Access Services. Immediately upon termination of this Addendum for any reason, the Fund shall return to State Street all copies of documentation and other Proprietary Information in its possession; provided, however, that in the event that either party terminates this Addendum or the Custodian Agreement for any reason other than the Fund’s breach, State Street shall provide the Data Access Services for a period of time and at a price to be agreed upon in writing by the parties.

Upon termination of this DAS Agreement for any reason, any right to use the System and access to the Data Access Services shall terminate and the Customer and its Authorized Designees shall immediately cease use of the System and the Data Access Services. Immediately upon termination of this DAS Agreement for any reason, the Customer and its Authorized Designees shall return to State Street all copies of documentation and other Proprietary Information in its possession; provided, however, that in the event that either party terminates this DAS Agreement or the Agreement for any reason other than the Customer’s breach, State Street shall provide the Data Access Services for a period of time and at a price to be agreed upon by the parties.

Immediately upon termination of this Addendum for any reason, the Customer and its Authorized Designees shall return to State Street all copies of documentation and other Proprietary Information in its possession and immediately cease access to the System and Data Access Services; provided, however, that in the event that either party terminates this Addendum, the Administrative Services Agreement or the Custodian Agreements for any reason other than the Customer’s breach, State Street shall provide the Data Access Services for a period of time and at a price to be agreed upon by the parties. Customer’s use of any third party System is contingent upon Customer’s and Authorized Designees’ compliance with any terms and conditions of use of such System imposed by such third party and State Street’s continued access to, and use of, such third party System.

Immediately upon termination of this Addendum for any reason, the Customer shall return to State Street all copies of documentation and other Proprietary Information in its possession and State Street shall return to Customer all Customer Data in its possession; provided, however, that in the event that either party terminates this Addendum or the Custodian Agreement for any reason other than the Customer's breach, State Street shall provide the Remote Access Services for a period of time and at a price to be agreed upon by the parties. Termination of the Right to Use. The User understands and hereby agrees that the rights to non-activated data and commands are granted until the moment of intended use, expiration of rights to non-activated data and commands, suspension or termination of the right to use EKSPA in accordance with the Agreement or for other reasons. Termination of rights to non-activated data and commands does not give the User a reason to demand from "Ekspa software" compensation of license fee for the rights to non-activated data and commands, except for the cases, provided for in this Agreement and valid law. If, because of a technical error, failure or User's actions, he / she has received rights to non-activated data and commands without payment, the User shall inform "Ekspa software" and pay the "Ekspa software" license fee if the User has started to use them.
