Term of Servicing Agreement. The term of this Servicing Agreement (the “Term”) shall commence as of the Effective Time and will terminate on the earlier of (i) October 31, 2011, or (ii) the date on which the data conversion process is complete, as evidenced by written notice from the Service Recipient acknowledged by the Service Provider. The Service Recipient shall have the right, at its option, to extend the Term for an additional period not to exceed 60 days, by giving written notice of such election to the Service Provider no later than October 15, 2011.

Term of Servicing Agreement. The term of TCSI's obligation to service the credit card accounts pursuant to this Agreement shall expire on the earlier to occur of (x) the second anniversary of the Closing Date and (y) the Repurchase Date. Notwithstanding anything herein to the contrary, in no event shall the Master Servicer assume any of the obligations of Xxxxxx Capital under the Master Servicing Agreement; and in connection with the performance of the Master Servicer's duties hereunder, the parties and other signatories hereto agree that the Master Servicer shall be entitled to all of the rights, protections and limitations of liability afforded to the Master Servicer under the Trust Agreement.
