A surviving spouse option may be elected only with respect to a spouse to whom the member is married or in a common law relationship for at least three (3) years, or in a relationship of some permanence if they are the parents of a child, and not living separate and apart, at the date pension payments commence. In any event, if the member or his designated spouse died before the effective date of the election, the election shall be automatically cancelled. The reduced pension payable to the member will be ninety (90) percent of the normal pension payable to the member minus one-half of one (1) percent for each full year by which the spouse is more than five (5) years younger than the member, or increased by one-half of one

A surviving spouse option may be elected only with respect to a spouse to whom the member is married at the date of election and has been married for at least one (1) year prior to that date. In any event, if the member or his designated spouse died before the effective date of the election, the election shall be automatically cancelled. The reduced pension payable to the member will be 90% of the normal pension payable to the member minus one-half of 1% for each full year by which the spouse is more than five (5) years younger than the member, or increased by one-half of 1% (to a maximum of 100%) for each full year by which the spouse is older than the member. The pension payable during the spouse’s lifetime after the death of the member will be 60% of the member’s reduced pension.

If, as of the annuity starting date, the Participant is married, a qualified joint and survivor annuity is an immediate annuity which is purchasable with the Participant's Nonforfeitable Accrued Benefit and which provides a life annuity for the Participant and a survivor annuity payable for the remaining life of the Participant's surviving spouse equal to 50% of the amount of the annuity payable during the life of the Participant. If, as of the annuity starting date, the Participant is not married, a qualified joint and survivor annuity is an immediate life annuity for the Participant which is purchasable with the Participant's Nonforfeitable Accrued Benefit. On or before the annuity starting date, the Advisory Committee, without Participant or spousal consent, must direct the Trustee to pay the Participant's Nonforfeitable Accrued Benefit in a lump sum, in lieu of a qualified joint and survivor annuity, in accordance with Section 6.01, if the Participant's Nonforfeitable Accrued Benefit is not greater than $3,500. This Section 6.04(A) applies only to a Participant who has completed at least one Hour of Service with the Employer after August 22, 1984.

  • Qualified Joint and Survivor Annuity An immediate annuity for the life of the Participant with a survivor annuity for the life of the spouse which is not less than 50% and not more than 100% of the amount of the annuity which is payable during the joint lives of the Participant and the spouse and which is the amount of benefit which can be purchased with the Participant's vested account balance. The percentage of the survivor annuity under the Plan shall be 50% (unless a different percentage is elected by the Employer in the Adoption Agreement).

Unless the applicable pricing supplement states otherwise, interest on the Securities will be computed on the basis of a 360-day year of twelve 30-day months. Interest payments on this Security will include interest accrued from and including the last date in respect of which interest has been paid or duly provided for (or from and including the Original Issue Date if no interest has been paid or provided for) to but excluding the Interest Payment Date or the Maturity Date, as the case may be.
