Statement of Basic Principles. 1. Any teacher or group of teachers may at any time present grievances through the grievance procedure and have them adjusted without the intervention of the Union, as long as the adjustment is not inconsistent with the terms of this Agreement, provided that the Union has been given an opportunity to be present at such adjustment. 2. If any such grievance arises, there shall be no stoppage or suspension of work on the part of the teacher(s) or Union because of such grievance. 3. A teacher who participates in these grievance procedures will not be subjected to discipline or reprisal because of such participation. 4. The failure of a teacher or the Union to act within the time limits will act as a bar to any further appeal and an administrator's failure to give a decision within the time limits shall permit the grievant to proceed to the next step. The time limits, however, may be extended by mutual agreement in writing. 5. The grievant has a right to be present and to be represented. If the teacher elects to be represented under the formal grievance procedures, his/her representative will not be from any organization other than the local Union. 6. Hearings and conferences held under this procedure shall be conducted by mutual agreement at a time and place which will afford a fair and reasonable opportunity for all persons, including witnesses entitled to be present, to attend. When such hearings and conferences are during school hours, employees whose presence is required shall be excused without loss of pay, for that purpose. 7. Under the following procedure, it is agreed that no grievance will be suspended or delayed by the summer vacation.
