Spousal Consent Not Required. Notwithstanding any other provisions of the Plan to the contrary, the consent of the Participant's spouse to any election, consent or beneficiary designation made or provided by the Participant shall not be required if it is established to the satisfaction of the Plan Administrator that there is no spouse, the spouse cannot be located or such other circumstances exist as may be prescribed by Treasury regulations, or any rulings or other promulgations issued by the Internal Revenue Service.

In the event that spousal consent is required, no loan shall be made pursuant to this Section 8.6 unless the spouse of the Participant consents to the loan. To be valid, the consent of such spouse must be in writing, must acknowledge the effect of the loan and the use of the Account as security for the loan and must be witnessed by a notary public. The consent of the spouse must be given within ninety (90) days prior to the date the loan is made and must relate to that specific loan. The consent given by the spouse to whom the Participant was married at the time the loan was made shall be effective with respect to that spouse and each subsequent spouse of the Participant. A new consent shall be required if the Account is used for renegotiation, extension, renewal or other revision of the loan.

  • Spousal Consent If any individual Stockholder is married on the date of this Agreement, such Stockholder’s spouse shall execute and deliver to the Company a consent of spouse in the form of Exhibit B hereto (“Consent of Spouse”), effective on the date hereof. Notwithstanding the execution and delivery thereof, such consent shall not be deemed to confer or convey to the spouse any rights in such Stockholder’s Shares that do not otherwise exist by operation of law or the agreement of the parties.   • Definitions; Consent Required The term "Utility Installations" is used in this Lease to refer to all air lines, power panels, electrical distribution, security, fire protection systems, communications systems, lighting fixtures, heating, ventilating and air conditioning equipment, plumbing, and fencing in, on or about the Premises.
