Common use of Shift Break Clause in Contracts

Shift Break. Employees must have a minimum break of 10 hours from the time they complete one shift and the time they start the next shift. If an employee needs to take time off that they would normally be working to take this break then they will not lose pay for that time off work. If Downer requires the employee to start working before they are able to take the ten hour break, then the employee will be paid at double time for all of the time they work until they are able to take the ten hour break. These hours will count towards ordinary hours for the purpose of accruals.

Shift Break. Employees must have a minimum break of 10 ten (10) hours from the time they complete one shift and the time they start the next shift. If an employee needs is required to take time work less than 4 consecutive shifts defined as shift work under 24.1 and resumes back on day shift then after taking a minimum of ten (10) consecutive hours off duty then that they would normally be working employee is entitled to take this break then they will not lose pay for that time off work. If Downer requires the employee to start working before they are able to take the ten hour break, then the employee will be paid at double time for all of the time they work until they are able to take the ten hour break. These hours will count towards ordinary hours for the purpose of accrualsOrdinary Hours occurring during such absence.
