Common use of Shift Break Clause in Contracts

Shift Break. It is intended that every employee shall have a full eight (8) hours break between shifts. In the event that an employee is recalled to work before such shift break has elapsed, he/she shall be considered as still working on his/her previous shift and shall be paid the appropriate overtime rates for work performed after recall. No employee shall be permitted to begin his/her next shift of his/her own accord until a full shift break has elapsed.

No employee shall be permitted to begin his/her next shift resume work of his/her own accord until a full ten (10) hour shift break has elapsedoccurs without permission of his/her supervisor. No employee shall be required to resume work until a full shift break occurs.

If any employee is instructed to report to work at a time later than his regular starting time to allow the eight hour break, the employee shall be paid for a full shift, for which he is reporting. In the event that of an emergency and the employee is recalled to work before such shift an eight (8) hour break has elapsed, he/she he shall be considered as still working on his/her the previous shift and shall be paid the appropriate overtime rates for all work performed after the recall. No employee shall be permitted to begin his/her next shift of his/her own accord until a full shift break has elapsed.
