Secondary Usage. The payment for secondary usage for recordings other than feature films and television programme soundtracks will be negotiated on a case-by-case basis. For all feature film and television programme soundtracks, secondary usage shall be paid for at the rate of $1 per call per musician or a proportion of 50% of the income the SSO receives for secondary usage, whichever is greater. The distribution of the musicians’ 50% share will be determined by the Management Committee.
Secondary Usage. (i) BSO may use excerpts from any Recording for secondary purposes including compilation products, related to promotion of BSO and to reach audiences who are unable to access the concert hall such as, but not limited to Health, Care and Educational settings.

  • Excess Usage If during a Billing Period, In Energy is greater than zero (0), then Excess Usage for that Billing Period will be calculated. If Excess Usage is greater than zero (0), then for the Facility and any secondary account at the conclusion of that Billing Period: (i) kilowatt-hour usage will equal the value of Excess Usage and (ii) Unused Credits are equal to zero (0). It is recognized that it is not necessary that all secondary factors support creation of an independent contractor relationship, but rather that overall there are significant secondary factors which indicate that CONTRACTOR is an independent contractor. By their signatures to this Agreement, each of the undersigned certifies that it is his or her considered judgment that the CONTRACTOR engaged under this Agreement is in fact an independent contractor.

The report is to be submitted electronically via electronic mail utilizing the template provided in Microsoft Excel 2003, or newer (or as otherwise directed by OGS), to the attention of the individual shown on the front page of the Contract Award Notification and shall reference the Group Number, Award Number, Contract Number, Sales Period, and Contractor's (or other authorized agent) Name, and all other fields required. OGS reserves the right to amend the report template without acquiring the approval of the Office of the State Comptroller or the Attorney General.
